Common use of Term; Expiration Clause in Contracts

Term; Expiration. This Agreement shall become effective on the initial Effective Date, and the obligations of the parties hereunder shall not commence until the initial Effective Date. Unless sooner terminated pursuant to this Section 10, this Agreement shall expire at the end of the Offering Period. This Agreement may be earlier terminated (i) by the Company pursuant to Section 10(b), and (ii) by the Dealer Manager pursuant to Section 10(c). The date upon which this Agreement shall have so expired or been terminated earlier shall be referred to as the “Termination Date”. For the avoidance of doubt, from and after the occurrence of the Termination Date, the Company shall have the right to commence and undertake preparations to commence a public offering of Common Shares.
