Term and Interest. Under Paragraph (5) entitled “Term and Interest”, please delete the first sentence and insert, “Subject to the terms hereof; this agreement shall remain in full force and effect for a term of two (2) years from the date Saba commences operations hereunder or until such time as Saba has expended the total sum of ten million dollars ($10,000,000) whichever first occurs.”

Term and Interest. The date of maturity of the Note shall be six (6) months from the date of issuance, subject to prepayment as set forth in paragraph 2 hereof. If it is determined that repayment of a CalHome loan at the maturity date causes a hardship to the homeowner, the Program Operator may opt to:  Amend the Note and Deed of Trust to defer repayment of the amount due at maturity for up to 30 additional years (at 0% additional interest). This may be offered one time.  Convert the debt at loan maturity to an amortized loan, repayable in 15 years at 0% additional interest. Borrowers must maintain the property in post-rehabilitation condition for the term of the loan. Should the property not be maintained in accordance with the Agreement, the loan shall be considered in default and will become due and payable. If necessary, foreclosure proceedings will be initiated. 6-C. LOAN CONDITIONS Title Insurance Once the loan application has been approved by the Hammers For Hope Board of Directors, the Program Operator will open escrow on the loan. At that point, the escrow officer will perform a preliminary title search to determine their ability to offer title insurance.

  • Late Charge and Interest Tenant acknowledges and agrees that the late payment of any Rent will cause Landlord to incur additional costs, including administration and collection costs, processing and accounting expenses, and increased debt service (the “Delinquency Costs”). Landlord and Tenant agree that it is difficult to ascertain the damage that Landlord will suffer as a result of the late payment of any Rent and that the Late Charge and interest are the best estimates of the damage that Landlord will suffer in the event of late payment. If a Late Charge becomes payable for any two (2) installments of Rent within any twelve (12) month period, then all Rent will automatically become due and payable quarterly in advance.

In the event any check, bank draft or negotiable instrument given for any payments under this Lease shall be dishonored at any time for any reason whatsoever not attributable to Landlord, Landlord shall be entitled, in addition to any other remedy that may be available, to an administrative charge of $200.00.

  • Expenses and Interest If, after a Change in Control of the Company, (a) a dispute arises with respect to the enforcement of the Executive’s rights under this Agreement or (b) any legal or arbitration proceeding shall be brought to enforce or interpret any provision contained herein or to recover damages for breach hereof, in either case so long as the Executive is not acting in bad faith, then the Company shall reimburse the Executive for any reasonable attorneys’ fees and necessary costs and disbursements incurred as a result of the dispute, legal or arbitration proceeding (“Expenses”), and prejudgment interest on any money judgment or arbitration award obtained by the Executive calculated at the rate of interest announced by U.S. Bank National Association, Minneapolis, Minnesota, from time to time at its prime or base lending rate from the date that payments to him or her should have been made under this Agreement.
