TENANT WAIVERS. Tenant hereby waives any right at law or in equity which it might have to terminate this Lease on account of any damage or destruction to the Premises, the Building and/or the Shopping Center, including all rights under California Civil Code Sections 1932(2) and 1933(4), and any similar or successor statutes. In the event of any such damage or destruction, the rights, duties and obligations of the parties shall be governed solely by the applicable provisions of this Lease with respect thereto.
TENANT WAIVERS. To the extent permitted by law, TENANT hereby waives: (a) jury trial in any action or proceeding regarding a monetary default by TENANT and/or LANDLORD’s right to possession of the Premises, and (b) in any action or proceeding by LANDLORD for monies owed by TENANT and/or possession of the Premises. TENANT WAIVERS. Tenant, on its own behalf and on behalf of all persons claiming through or under Tenant including all creditors, does hereby waive any and all rights and privileges, so far as is permitted by law, which Tenant and all such persons might otherwise have under any present or future law, to (i) the service of any notice of intention to re-enter or institute legal proceedings to that end, excluding service of process, (ii) redeem the Premises, (iii) re-enter or repossess the Premises, or (iv) restore the operation of this Lease, after Tenant shall have been dispossessed by a judgment or by warrant of any court or judge, or after any re-entry by Landlord or after any expiration or termination of this Lease and the Term, whether such dispossess, re-entry, expiration or termination shall be by operation of law or pursuant to the provisions of this Lease. The words “re-enter,” “re-entry” and “re-entered” as used in this Lease shall not be deemed to be restricted to their technical legal meanings.

TENANT WAIVERS. Tenant hereby waives all rights under, and benefits of, subsection 1 of Section 1932 and Section 1941 and 1942 of the California Civil Code and under any similar law, statute or ordinance now or hereafter in effect.
TENANT WAIVERS. FirstWorld shall not provide telecommunications services to any tenant of a Building unless and until a Waiver and Release, substantially in the form attached as Appendix 7 hereto, has been duly executed by such tenant and delivered by FirstWorld to Irvine, provided, however, that FirstWorld may satisfy the requirements of this Section 4.5 by including language similar to that contained in Appendix 7 in its standard service agreement for the benefit of Irvine.
TENANT WAIVERS. Waivers of this lease shall be in writing by the Landlord and Tenant for that specific part initialed and no other part.
