TENANT FINISH IMPROVEMENTS. Tenant accepts the Premises in "AS IS, with all faults" condition, with no representations or warranties of any kind by or on behalf of Landlord with regard to the Premises. Landlord shall have no obligation to construct any tenant improvements or make any other changes to the Premises except as expressly provided herein.

TENANT FINISH IMPROVEMENTS. Landlord shall construct certain tenant finish improvements to the Initial Premises in accordance with the schematic drawings and specifications attached to this Lease, made a part hereof and marked Exhibit “C” and the Work Letter attached to this Lease, made a part hereof and marked Exhibit “F”. Landlord shall also construct tenant finish improvements for the Additional Premises in accordance with schematic drawings and specifications to be agreed to by Landlord and Tenant and attached to this Lease as Exhibit “C-1” and the Work Letter.
TENANT FINISH IMPROVEMENTS. Landlord agrees to perform and complete the work on the tenant finish improvements for the Leased Premises ("Tenant Finish Improvements") in accordance with Tenant's plans and specifications which shall be mutually agreed upon by both Landlord and Tenant and, upon completion, attached hereto as Exhibit B-2 ("Interior Plans and Specifications"). Landlord shall allow Tenant to review the major subcontractor bids associated with such work. Landlord shall provide an allowance for the costs of the tenant finish improvements to the Leased Premises in an amount not to exceed Twenty-three Dollars ($23.00) per rentable square foot of the Leased Premises (the "Tenant Finish Allowance"). Landlord further agrees to provide an allowance for the costs of initial space planning and construction drawing services, to be completed by Tenant's selected space planner, in the amount of One Dollar and Twenty-five Cents ($1.25) per rentable square foot of the Leased Premises (the "Design Allowance"). The Tenant Finish Allowance shall be used to construct and pay for the Tenant Finish Improvements and , any remaining balance may be used for costs of wiring, cabling, relocation and other associated expenses of Tenant. The Tenant Finish Allowance shall be paid by Landlord directly to the Construction Manager (as hereinafter defined), contractor, and/or subcontractors performing the Tenant Finish Improvements, and after completion of all Tenant Finish Improvements and payment of all costs relating thereto, the remaining balance shall be made available to Tenant for payment of such wiring, cabling, relocation and other associated expenses of Tenant, which expenses shall be reimbursed to Tenant by Landlord within thirty (30) days of Landlord's receipt of invoices for such other expenses from Tenant, provided that the final costs of the Tenant Finish Improvements shall have been determined. Any unused portion of the Tenant Finish Allowance up to an amount not to exceed Three Dollars ($3.00) per rentable square foot of the Leased Premises shall be applied in equal monthly installments toward Tenant's Minimum Annual Rent hereunder over the initial Lease Term hereof. Tenant shall reimburse Landlord for any cost or expense attributable to the Tenant Finish Improvements which exceeds the Tenant Finish Allowance no later than the Commencement Date. TENANT FINISH IMPROVEMENTS. Tenant acknowledges that it has inspected the Premises and accepts the Premises in “as is” condition, provided that Landlord shall have the carpets in the Premises professionally cleaned and Landlord shall perform minor wall touchup (collectively, the “Tenant Finish Improvements”). (The currently existing improvements by Landlord to the Premises, together with the Tenant Finish Improvements, are collectively referred to herein as “Landlord’s Work.”) Landlord shall allow Tenant full use of all of the furniture currently located in the Premises (which furniture is listed on Exhibit “C” attached hereto and made a part hereof) during the term of this Lease, including any renewal terms. If Tenant renews or extends the Lease for a period of three (3) or more years, provided Tenant is not then in default of the Lease, the furniture currently located in the Premises shall become Tenant’s property at no additional cost to Tenant.
TENANT FINISH IMPROVEMENTS. Section 2.02.B. of the Lease is hereby amended by deleting Exhibit B-2 and substituting Amended Exhibit B-2 in lieu thereof.

The Tenant Finish Allowance shall be paid by Sublandlord directly to Landlord and after completion of all Tenant Finish Improvements and payment of all costs relating thereto, the remaining balance shall be made available to Subtenant for payment of wiring, cabling, relocation and other associated expenses of Subtenant, which expenses shall be reimbursed to Subtenant by Sublandlord within thirty (30) days of Sublandlord’s receipt of invoices for such other expenses from Subtenant. Subtenant shall pay for any cost or expense attributable to the Tenant Finish Improvements which exceeds the Tenant Finish Allowance no later than the Commencement Date.

TENANT FINISH IMPROVEMENTS. Landlord shall, at its sole cost and expense, deliver the Premises to Tenant in "turnkey condition pursuant to the space plan attached to the Lease as Exhibit B using building standard materials. Landlord has designated the type and quantities of materials to be used In the construction of the Tenant Finish Improvements (hereinafter referred to as "Building Standard Construction"). Building Standard Construction shall be utilized for the Tenant Finish Improvements. Landlord shall have the right to designate, and from time to time to change, the materials, fixtures, colors and other items that are Building Standard Construction, provided that such changes are of equal or superior quality.
TENANT FINISH IMPROVEMENTS. Lanxxxxx xxrees to perform and complete, at Lanxxxxx'x sole cost and expense, the work on the tenant finish improvements for the Leased Premises ("Finish Work") in accordance with Tenant's preliminary space plans and specifications which are attached hereto as Preliminary Exhibit B-2, subject to events and delays due to causes beyond its Landlord and Tenant hereby agree that all work on any subsequent tenant finish improvements in the Leased Premises and any expansion space shall also be performed by Duke Construction Management, Inc. or an affiliate of Landlord (collectively "Construction Manager") which shall receive a construction management fee equal to the fair market rate for comparable tenant finish construction work, including quality, experience, reliability and availability of Construction Manager.
