Technical and Professional Capacity. 2.1 Sufficient experience and capacity providing conference facilities and catering services. A tenderer may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which he has with these entities. In that case, the following rules apply: • Where an economic operator wants to rely on the capacities of other entities, it shall prove to the contracting authority that it will have at its disposal the resources necessary, for example, by producing a commitment by those entities to that effect. • The contracting authority shall verify whether the entities on whose capacity the economic operator intends to rely fulfil the relevant selection criteria and whether there are grounds for exclusion. • Where an economic operator relies on the capacities of other entities with regard to criteria relating to economic and financial standing, the contracting authority may require that the economic operator and those entities be jointly liable for the execution of the contract. • The contracting authority may require certain essential tasks to be carried out directly by the tenderer himself or, if the tender is submitted by a group of economic operators, by a member of the said group. Under the same conditions, a group of candidates or tenderers may submit the capacities of the group’s participants or of other entities. Regularity of tenders The tenders submitted by the selected tenderers will be evaluated as to formal and material regularity. Irregular tenders will be rejected. The contracting authority reserves the right to have the irregularities in the tenderers’ tender regularised during the negotiations.

Technical and Professional Capacity. Tenderers should show their degree of technical and professional capacity to carry out the requested tasks by providing information on the criteria described below. If several service providers or subcontractors are involved in the tender, the selection criteria for the technical and professional capacity will be assessed in relation to the combined capacities of the service providers and subcontractors, as a whole, to the extent that service providers or subcontractors put their resources at the disposal of the tenderer for performance of the contract.

Technical and Professional Capacity. The tenderer shall provide evidence of its technical and professional capacity to perform the contract. The tenderer must have at least three years of professional experience in providing similar services, i.e. renting of mobile office and toilet containers. Evidence of that must be provided by: - a list of contracts for similar services executed on the subject in the past three years (at least one contract in a given year), specifying the tenderer’s share (at least 50%) in provision of the services and if subcontractors were used for any of the services. A list should be prepared for each lot it the Tenderer is bidding for more than one lot. - at least three reference letters for each lot issued and signed by an authorised person of that particular Xxxxxxxx’s client from the list above, confirming satisfactory provision of services. The Tender should appoint a Contract Manager (CM) and an alternate one who will be assigned to support the framework contract implementation, clearly defining their roles and responsibilities. Technical and Professional Capacity. The technical and professional capacity of the Tenderers to provide the services required will be assessed with regard to their know-how, efficiency, effectiveness, experience, reliability in providing the required expertise. The Tenderer needs to demonstrate in the Offer the capacity to deliver in parallel several events/technical meeting of the kind requested in the technical specifications, as well as to have the capacities to provide the services for upcoming events, which were not mentioned in indicative planning – even at a relatively short term notice. In the case of joint offer (consortium) or subcontracting, the technical and professional capacity shall be assessed in relation to the combined capacity of all the parties involved in the tender. Evidence of the technical and professional capacity shall be presented in Standard Submission Forms by the following: - Reference list (including contact details) of minimum 5 and maximum 10 current and past costumers to whom the Tenderer has supplied the core services, as they are specified in Section 1.2.3, in the past 3 years; specifying the Tenderer’s share in provision of the services and if subcontractors were used for any of the services.
