Target Completion Date. As defined in Section 3.3(b).
Target Completion Date. The Landlord shall exercise reasonable care to cause the Landlord's Work at the Demised Premises to be substantially complete on or prior to the Target Completion Date. The failure of Landlord to complete the Landlord’s Work and deliver the Demised Premises to Tenant on or before the Target Completion Date shall not make this Lease void or voidable, and Landlord shall not be in default or liable to Tenant; provided however, in the event Landlord's Work is not completed and the Demised Premises tendered to Tenant within NINETY (90) days following the Target Completion Date for any reason other than a Tenant Delay or reasons within Landlord’s control, then this Lease shall automatically become null and void and neither party hereto shall have any further rights or obligations hereunder. If the reason for Landlord’s Work not being completed within Ninety (90) days following the Target Completion date is for reasons within Landlord’s control, Tenant shall have the option of terminating this Lease by giving Landlord written notice within the following thirty (30) days and neither party shall have any further rights or obligations hereunder. In the case of either type of termination, Landlord shall refund any prepaid rent and Security Deposit to Tenant. This right to terminate if Landlord’s Work is not completed shall not supersede Landlord’s obligation above to exercise reasonable care to cause Landlord’s Work to be substantially complete on or prior to the Target Commencement Date. Under no circumstances shall Landlord be liable to Tenant for any damages including, but not limited to, direct, indirect, and consequential or incidental damages, which may be caused by any delay in commencing or completing its construction of the Demised Premises or for a total failure to complete same. The parties confirm and agree that the completion of Landlord's Work may be delayed for reasons beyond the Landlord's control, including those reasons commonly known as Force Majeure, and hereby agree that the Target Completion Date shall automatically be extended if and to the extent that any delays are encountered which are not within the control of the Landlord. Target Completion Date. Landlord shall use its reasonable efforts to cause the Leasehold Improvements to be substantially completed on or before May 15, 2002 ("Target Completion Date"). Landlord shall not be liable to Tenant for any damages, losses, costs or expenses incurred by Tenant because of a failure to substantially complete the Leasehold Improvements on or before the Target Completion Date.
Target Completion Date. AEP Texas shall use commercially reasonable efforts to complete the Work within 24 months from the Effective Date (“Target Completion Date”). However, AEP Texas does not promise to complete the Work by the Target Completion Date; and in no event shall AEP Texas have any liability to Customer or any third party in the event that AEP Texas is unable to complete the Work by the Target Completion Date. If Customer requests AEP Texas to delay performance of the Work, and AEP Texas agrees to such a delay, the Target Completion Date shall be extended to account for the effects of the requested delay. Customer will also pay AEP Texas an additional CIAC Payment for any increase in estimated cost of performing the Work resulting from such delay, including demobilization and remobilization costs and suspension, termination or cancellation costs payable to third parties. If, after initiation of a requested delay, Customer does not authorize AEP Texas to recommence the Work on or before July 1, 2019, then AEP Texas may, at its option, cancel this Agreement. Customer recognizes that events beyond the reasonable control of AEP Texas may make it necessary to extend the Target Completion Date. If AEP Texas reasonably determines that it will not be able to complete the Work by the Target Completion Date, AEP Texas will notify Customer, and the Target Completion Date will be adjusted to reflect the earliest date that AEP Texas reasonably determines that it can complete the Work.
Target Completion Date. July 15, 2007. Notwithstanding the foregoing, if the EPA Vacation Date shall occur after August 31, 2006, then the Target Completion Date shall be extended by one day for each day after August 31, 2006 until the EPA Vacation Date occurs.

The parties confirm and agree that the completion of Landlord’s Work may be delayed for reasons beyond the Landlord’s control, including those reasons commonly known as Force Majeure, and hereby agree that the Target Completion Date shall automatically be extended if and to the extent that any delays are encountered which are not within the control of the Landlord. Notwithstanding the foregoing, in the event Landlord’s Work is not completed within NINETY (90) Forty-Five (45) days following the Latest Target Completion Date, then Tenant shall have the option to terminate this Lease. This Lease Agreement shall automatically become null and void and neither party hereby shall have any further rights or obligations hereunder. Under no circumstances shall Landlord be liable to Tenant for any damages including, but not limited to direct, indirect, and consequential or incidental damages, which may be caused by any delay in commencing or completing its construction of the Demised Premises or for a total failure to complete same.
Target Completion Date. October 1, 2005, subject to extension due to Excusable Delay and/or as provided in Section 3.1(c).
