TANK CARS. 6.1 If tank cars owned or leased by Seller are used to deliver Product hereunder and they are not unloaded and returned to the railroad within one Day of being Constructively or Actually Placed, Buyer shall be liable to Seller for rental at the rate of (i) $75.00 for each Day (or fraction thereof) in excess of five Days; (ii) the then applicable third party lease rate for tank cars on the spot market in the vicinity of the delivery point for the Product; or

TANK CARS. If tank cars owned or leased by Seller are used to deliver Product hereunder and they are not unloaded and returned to the railroad within five (5) days of arrival, Purchaser shall be liable to Seller for rental at the rate of (i) $150.00 for each day (or fraction thereof) in excess of five (5) days. Tank cars shall not be diverted without Seller's prior written consent.
TANK CARS. Buyer will be responsible for providing a minimum of one hundred eighty (180) Tank Cars needed for rail transportation and will manage Seller’s Tank Car fleet. Buyer will lease 1232 Tank Cars to Seller at [***] per Tank Car per month. Buyer will lease 117R Tank Cars to Seller at [***] per Tank Car per month. Effective January 1, 2025, Murex will provide at Cardinal’s request DOT 117R Tank Cars for [***] per Tank Car per month. These amounts will be billed by Buyer to Seller on or before the first (1st) day of the month for the previous month, and Seller will pay Buyer no later than the [***] day of each month for Tank Car leases. Xxxxx and Xxxxxx will develop a plan and work together to satisfy Seller’s Tank Car needs.
TANK CARS. Seller has its own fleet (the “Fleet”) of leased Tank Cars. Murex will manage the Fleet and help Seller optimize the value of its Tank Cars. Buyer will provide Tank Cars as needed and if requested, at an agreed-upon rate, to bridge any time gap between when Tank Car leases expire and the Term of this Agreement.   • Loading RPMG shall schedule the loading and shipping of all outbound corn oil purchased hereunder, but all labor and equipment necessary to load trucks and rail cars and other associated costs shall be supplied and borne by Producer without charge to RPMG. Producer shall handle the corn oil in a good and workmanlike manner in accordance with RPMG’s written requirements and normal industry practice. Producer shall maintain the truck and rail loading facilities in safe operating condition in accordance with normal industry standards and shall visually inspect all trucks and rail cars to assure (i) cleanliness so as to avoid contamination, and (ii) that such trucks and railcars are in a condition suitable for transporting the corn oil. RPMG and RPMG’s agents shall have adequate access to the Ethanol Facility to load Producer’s corn oil on an industry standard basis that allows RPMG to economically market Producer’s corn oil. RPMG’s employees shall follow all reasonable safety rules and procedures promulgated by Producer and provided to RPMG reasonably in advance and in writing. Producer shall supply product description tags, certificates of analysis, bills of lading and/or material safety data sheets that are applicable to all shipments. In the event that Producer fails to provide the labor, equipment and facilities necessary to meet RPMG’s loading schedule, Producer shall be responsible for all costs and expenses, including without limitation actual demurrage and wait time, incurred by RPMG resulting from or arising in connection with Producer’s failure to do so.

  • Fuel 28.1 The Vehicle must be returned with the amount of fuel equal to that at the time of the commencement of the rental. If the Vehicle is returned with less fuel, the difference will be charged to You at a rate of $5.00 including GST per litre (which includes a service component).

  • Storage The ordering agency is responsible for storage if the contractor delivers within the time required and the agency cannot accept delivery.
