Common use of Suspension for Convenience Clause in Contracts

Suspension for Convenience. The Owner may, without cause, order the Design/Builder in writing to suspend, delay or interrupt the Work in whole or in part for such period of time as the Owner may determine. An adjustment shall be made for increases in the cost of performance of the Work, including Fee on the increased cost of performance, caused by the suspension, delay or interruption, in accordance with the Change Order provisions of this Agreement. No adjustment shall be made to the extent the performance is, was or would have been so suspended, delayed or interrupted by another cause for which the Design/Builder is responsible. Adjustments made in the cost of performance may have a mutually agreed fixed or percentage Fee.
