Common use of Surviving Spouse Clause in Contracts

Surviving Spouse. If the Executive dies with a surviving spouse, then such remaining payments shall be made to his surviving spouse (the “spouse”). If the spouse dies prior to receiving any or all of the payments to which she is due, then such remaining payments shall be made in accordance with the provisions of Section 12.2 of this Article, as if the spouse had not survived the Executive.
