Supervision Requirements. We require at least 1 responsible adult per 5 children under the age of 7 and 1 responsible adult per 8 children under the age of 10. Children 11 and over require a 15 to one ratio. Non-climbing children that are in the Climbing Wall or the ARC building, must be supervised by a parent or guardian at all times. This is our policy whether the child is using the climbing wall or not. To enhance the safety of all participants, there may be other supervision requirements that will be reviewed on the day of the rental. Unless otherwise stipulated, climbing wall parties include only the climbing wall and the table and chair area (party space) behind the climbing wall. Use of other activity areas is prohibited. Failure to comply with supervision requirements may result in cancelation of party. General Climbing Wall Rules: As you arrive for your event, please take the time to carefully read, sign and follow all facility rules on your climbing wall rules checklist form. The climbing wall rules are posted as you enter the climbing wall as well. Listed below are additional information and policies of particular importance: • The climbing wall is at height of 35 feet. • No running or rowdy behavior in and around the climbing wall. • Please be advised that the climbing wall is an adventure activity and may expose the climber to possible physical injury. In deciding to participate the climber assumes full responsibility of any injury sustained. Be aware that a climbing wall liability release must be read and signed. An optional helmet use wavier may also be needed. • To use the climbing wall you must fit into and be properly secured in an approved climbing harness. • Parents/guardians, non-climbers and climbers not on the wall must stay behind the floor tie-ins and/or if the area is crowded must view climbers through the windows from outside the wall. • All climbing gear must stay inside the climbing wall area.
Supervision Requirements. The Supervising Physicians will exercise supervision over the PA in accordance with all applicable laws and regulations, including but not limited to the New Jersey Physician Assistant Modernization Act and its implementing regulations, as amended from time to time. For purposes of this Agreement, as it relates to all settings, ''continuous supervision" means that the Supervising Physician need not be physically present, provided that a Supervising Physician maintains contact with the PA through electronic or other means of communication. The PA agrees and acknowledges that the PA is obligated to consult with a Supervising Physician when the PA has questions or concerns regarding patient treatment and management and/or when the patient's clinical condition requires medical decision-making beyond the PA's scope of practice, experience, or knowledge.

Children 11 and over require a 15 to one ratio. A maximum of 15 swimmers can be accommodated for the party. Non-swimmers and individuals on deck will not count toward the 15 swimmer maximum. Parents/guardians may be required to be in the water and within arm’s reach of children if the lifeguard staff determines there is a need to provide additional safety measures due to swimming capabilities of party participants. Individuals who are unable to swim and those who need flotation devices must always have an adult in the water and always within arm’s reach. To enhance the safety of all participants, there may be other supervision requirements that will be reviewed on the day of the rental. Unless otherwise stipulated, pool parties include the pool and deck area, (and spa if over the age of 16), the “wet” meeting room near the pool entrance and both the main locker rooms and the family changing room. Use of other activity areas is prohibited.
Supervision Requirements. In compliance with the NYS Office of Temporary and Disability Assistance’s (“OTDA”) Fiscal Reference Manual (“FRM”), Volume 3, Chapter 5, the Commissioner of HRA shall have organizational supervision of any staff working pursuant to the terms of this Agreement. The Commissioner of HRA may have input into the assignment, retention and reassignment of any staff working pursuant to this Agreement; however, the ultimate authority for these staff members shall remain with the appointing office.

If you are an individual, you must serve as the Operating Manager; however, if you are a business entity, you must appoint as the Operating Manager an individual acceptable to us and who must be identified in an exhibit to the Franchise Agreement and must at all times during the term of the Franchise Agreement own at least a 10% equity interest in you. The Operating Manager shall be available to be contacted by us at all reasonable times. The Operating Manager must have satisfactorily completed Start-Up Training and must devote his or her full time and energy during business hours to the supervision and management of the Franchised Business, unless otherwise exempted by permission of the Company.
