Subpoenaed Witnesses. Covered Employees subpoenaed as witnesses may be excused from their duties upon documentation of court notices for such witness service without any deduction in salary, unless the witness is being paid as an expert witness and is paid more than the statutory amount by the court.

Subpoenaed Witnesses. 10.11.1 Any Unit 8 employee subpoenaed, or ordered by the employer to appear, as a witness by virtue of his/her State employment shall be considered to be on duty. Any fees collected for such appearance shall be turned over to the State. The provisions of this Section do not apply if the employee is a party to the proceeding unless ordered by the employer or the employer is also a party and is aligned on the same side as the employee.
Subpoenaed Witnesses. An employee subpoenaed to testify as a witness in a federal or state criminal or civil proceeding to which they are not a party may use personal leave, or if personal leave is exhausted, accumulated sick leave days to prevent loss of pay for such time spent in response to the subpoena. The employee will be required to reimburse the school district with any witness fee payments the employee receives when personal leave is used.
