Common use of Sublessor Made Party to Litigation Clause in Contracts

Sublessor Made Party to Litigation. If Sublessor or Sublessee becomes a party to any litigation brought by someone other than the other party and concerning this Sublease, the Subleased Premises, or the other party’s use and occupancy of the Subleased Premises to the extent, based upon any real or alleged act or omission of such other party or its authorized representatives, such other party shall be liable to the first party for reasonable attorneys’ fees and court costs incurred by the other in the litigation.

Sublessor Made Party to Litigation. If Sublessor or Sublessee becomes a party to any litigation brought by someone other than the other party sublessee and concerning this Sublease, the Subleased Premises, or the other party’s Sublessee's use and occupancy of the Subleased Premises to the extent, based upon any real or alleged act or omission of such other party Sublessee or its authorized representatives, such other party Sublessee shall be liable to the first party Sublessor for reasonable attorneys’ ' fees and court costs incurred by the other Sublessor in the litigation.
