Step II – Superintendent. If the grievant or the Association is not satisfied with the disposition of the grievance at Step I, or if no decision has been rendered within ten (10) days after presentation of the grievance, then the grievance, within ten (10) days, may be referred to the superintendent or the superintendent's designee. The superintendent/designee shall arrange for a meeting with the grievant to take place within ten (10) days after receipt of the appeal. Upon conclusion of the meeting, the superintendent will have ten (10) days to provide the grievant with a written decision.

Step II – Superintendent. If the grievant is not satisfied with the disposition of the grievance at Step I, the grievant and/or the Association shall appeal the decision to the Superintendent within seven (7) days of receiving the Step I decision. The Superintendent shall conduct a meeting with the grievant and/or the Association within seven (7) days of receiving the notice of appeal. The Superintendent will then issue his/her decision in writing by completing Grievance Report Form B (Appendix B) and forwarding it to the grievant within seven (7) days of the meeting. The Association and the immediate supervisor shall be notified by the Superintendent in writing of said disposition.
Step II – Superintendent. A. If the aggrieved is not satisfied with the response received from the administrator in Step I, he/she may within five (5) days of receipt of such written response, submit his/her written grievance to the Superintendent and request a meeting to discuss the grievance.

Step III - Arbitration If no Step II decision is rendered, the Association, within 15 working days of the receipt of the Step II decision or within 25 working days of the formal filing date at Step II may appeal to the American Arbitration Association or the Federal Mediation and Conciliation Service for arbitration under the voluntary rules. The arbitrator shall hold a hearing within 30 working days of his/her appointment. Ten (10) working days notice shall be given to both parties of the time and place of the hearing. The arbitrator will issue his/her decision within 30 working days from the date final written briefs have been submitted or, if revised by both parties, 30 working days after completion of the hearing. The arbitrator's decision will be in writing and will set forth his/her findings of fact, reasoning and conclusions on the issues submitted to him/her. The decision of the arbitrator shall be final and binding upon the employer, the Association and the grievant(s).
