Common use of Step Four Clause in Contracts

Step Four. If a grievance is not resolved in the third step, the fourth step shall be referral by the Association to mediation within ten (10) work days of the answer in Step Three. Whenever a grievance is referred to mediation, either party shall request that the California State Mediation and Conciliation Service refer a State Mediator. The State Mediator shall assist the parties in the resolution of the grievance in the same manner as that which is normally used in the mediation of interest disputes. Referral to Step Five shall not occur until the Mediator has released the parties from the mediation process.

Step Four. If a grievance is not resolved in the third step, the fourth step shall be referral by the Association Organization to mediation within ten twenty (1020) work calendar days of the answer in Step Threestep three. Whenever a grievance is referred to mediation, either party shall request the Organization or the City may request, in writing, that the California State Mediation and Conciliation Service refer a State Mediatorstate mediator. The State Mediator mediator shall assist the parties Parties in the resolution of the grievance in the same manner as that which is normally used in the mediation of interest disputes. Referral to Step Five step five shall not occur until the Mediator a mediator has released the parties Parties from the mediation process.

If a grievance the disciplinary appeal is not resolved in the third stepStep Three, the fourth next step shall be the referral by of the Association matter to mediation by either party within ten twenty (1020) work days of the answer in to Step Three. Whenever a grievance is referred to mediation, either party shall the employee or the City may request that the California State Mediation and Conciliation Service (SMCS) refer a State Mediatorstate mediator. The State Mediator mediator shall assist the parties in the resolution of the grievance in the same manner as that which is normally used in the mediation of interest disputes. Referral to Step Five shall not occur until the Mediator mediator has released the parties from the mediation process. By mutual agreement of the parties, Step Four may be waived.
