Common use of Status of Exchanging Holder Clause in Contracts

Status of Exchanging Holder. Until the Holder of Units tendered for exchange pursuant to this Agreement becomes a holder of record of the Exchange Shares delivered in exchange therefor and/or has received in lieu thereof the Cash Amount, such Holder shall continue to hold and own such Units for all purposes of the Partnership Agreement. No Exchanging Holder shall have any rights as a shareholder in respect of the Exchange Shares to be delivered to such Holder unless and until such Holder becomes a holder of record of such shares.
