Common use of State Liability Clause in Contracts

State Liability. The State agrees that it is solely responsible and solely liable for complying with and carrying out this MOU, for the performance of all assigned responsibilities as provided by applicable law, and for any decisions, actions, or approvals by the State. The FHWA shall have no responsibility or liability for the performance of responsibilities assigned to the State, including without limitation any decision or approval made by the State pursuant to an assignment under 23 USC § 326. Where the State takes any subsequent substantive action under authority assigned in accordance with 23 USC § 326, on a proposed project which FHWA determined to be a CE prior 7 June 2007, the State assumes sole responsibility and liability for NEPA on that project.
