Stand-by Clause Examples

Stand-by. The status of an employee who has been specifically assigned by an appropriate supervisor to remain available for call-in at home or any location employer has been made aware of such that the employee can be contacted by telephone to report to work immediately upon notification from employer.
Stand-by. On rain sensitive work such as Dirt Work, Slab Work, and Asphalt Work or in such cases as equipment breakdown, the Employer may request the employees to remain on the job for up to two (2) hours on a standby basis. If not put to work during this two (2) hour period, the employee shall receive two (2) hours wages plus fringes but shall not receive the forty dollars ($40.00) reporting expense. If put to work, employees shall receive pay for actual hours worked in accordance with the minimum pay requirement of this article.
Stand-by. No worker shall be required or requested to be available for handling potential emergency situations or available to answer questions by telephone after he or she has clocked out for the day.
Stand-by. When Correctional Officers are ordered, as a result of emergency situations, to stand-by for duty, and restricted as to their movements while off duty, they will be compensated at twenty-five percent (25%) of their base salary for such time (one-half hour minimum). When Correctional Officers and Juvenile Correctional Officers are ordered to stand by for court time and restricted to their movement while off duty, they shall be compensated at twenty-five percent (25%) of their regular hourly rate for such time (one hour minimum).
Stand-by. 16.13.1 When the Employer requires an employee to be available on stand-by during off duty hours, an employee shall be compensated at the rate of one-half (½) hour for each four (4) hour period or portion thereof for which the employee has been designated as being on stand-by duty. 16.13.2 An employee designated by letter or by list for stand-by duty shall be available during their period of stand-by at a known telephone number and be able to return for duty as quickly as possible if called. In designating employees for stand-by duty the Employer will endeavour to provide for equitable distribution of stand-by duties. 16.13.3 No stand-by duty payment shall be granted if an employee is unable to report for duty when required. 16.13.4 An employee on stand-by duty who is required to report for work shall be paid, in addition to the stand-by pay, the greater of: (i) the applicable overtime rate for the time worked; (ii) the minimum of four (4) hours’ pay at the applicable overtime rate; except that this minimum shall only apply once during a single period of eight (8) hours stand-by duty. 16.13.5 Overtime earned under clause 16.13.4 shall be compensated in cash except where upon application by the employee and at the discretion of the Employer, overtime may be taken in the form of compensatory leave in accordance with clause 16.8 of the collective agreement. 16.13.6 Time spent by the employee called back to work or returning to his residence shall not constitute time worked. 16.13.7 The Employer agrees that in the areas and in the circumstances where electronic paging devices are both practicable and efficient they will be provided without cost to those employees on stand-by duty.

Stand-by. A. The stand-by period shall be fifteen (15) hours in duration for any night stand-by duty and shall be nine (9) hours in duration for any daytime stand-by. B. Stand-by duty shall mean that a department head has designated an employee to be immediately available for duty upon receipt of a message to report to work. If any employee assigned to stand-by duty is not available to report to duty when called, no stand-by pay shall be paid to the employee for the period and the employee may be subject to disciplinary action. C. Stand-by duty shall normally be voluntary. If there are no volunteers, assignments shall be made in inverse order of seniority, except, however, that the individual chosen for the stand-by duty shall be qualified to perform the tasks required. D. Any employee who has been designated by a department head to carry a beeper or other type of electronic communications equipment, after his/her normal tour of duty, shall be considered to be on stand-by, and shall be paid accordingly. E. An employee who is designated by the department head to be available on a stand-by basis to report to duty when necessary shall be reimbursed at a rate not to exceed twenty-five ($25.00) dollars for such stand-by period. F. If required to report for duty from stand-by status, the employee shall be paid at the appropriate overtime pay rate.
Stand-by. Consistent with the provisions of the Fair Labor Standards Act (FLSA), if the University assigns an employee to be in a stand-by status as determined by the FLSA, he or she shall be paid accordingly.
Stand-by. An employee, who has been designated by the employing authority or authorized supervisor to be available on stand-by during off duty hours on a regular working day, shall be entitled to payment for each eight (8) hour period of twenty dollars ($20.00).
