Staffing and Personnel. As the OEI budget demonstrates, the proposed staffing structure proposes a very lean regular staff, with a robust, carefully targeted contract staff of specialized skill sets. This keeps the long8term organization staffing costs low, increases organizational agility, and ensures rapid adaptation to emerging technologies or other changes in the technology landscape. ▇▇▇▇▇ has a strong reputation for managing contractor relationships, and as a result, has a pool of available and qualified candidates when needed to start up new efforts.
Staffing and Personnel. FLAGSHIP shall provide all Personnel necessary for the proper and effective performance of the Services. FLAGSHIP agrees that, to the extent their presence is reasonably required (and except for emergencies or other situations beyond their reasonable control), all Personnel shall attend all sales events that are scheduled and one of them along with the designated account executives shall attend weekly or biweekly meetings (as specified by PREDICTIVE) reporting on progress in the provision of the Services and execution of the plan for the Project. All Personnel shall have experience in the sales of health care services and shall be competent and with the skills and abilities to provide the Services at a proficient level. All Personnel shall have all licenses, permits and authorizations to perform the Services. No Personnel shall be excluded or suspended from participation in any state or federally funded health care program (including the Medicare and Medicaid Programs) and no Personnel shall have been convicted of a crime that substantially relates, in the reasonable judgment of PREDICTIVE, to the Services to be performed hereunder (including the reputation of PREDICTIVE in the marketplace and its interest in obtaining sales). All Personnel shall be subject to the initial and ongoing approval of PREDICTIVE (which approval shall not be unreasonably withheld). Without limiting the forgoing, FLAGSHIP will not use any person as Personnel unless such person has been interviewed by PREDICTIVE and approved by PREDICTIVE(which approval shall not be unreasonably withheld). The entire FLAGSHIP team shall devote such of their time as shall be necessary to assure the satisfactory performance, in the reasonable judgment of PREDICTIVE, of the Services. If PREDICTIVE wishes to withdraw its approval of any Personnel hereunder, PREDICTIVE shall first discuss with FLAGSHIP the reason for its withdrawal of approval before its approval is withdrawn. Upon such withdrawal, FLAGSHIP shall not utilize such disapproved Personnel in work under this Agreement. FLAGSHIP shall also exercise commercially reasonable efforts to maintain the continuity of the Personnel with respect to the Project. Staffing and Personnel. To the extent that Operator’s personnel, Operator’s subcontractors and/or such subcontractor’s personnel are identified in the Scope of Services, the Business and Operations Plan (as defined in Section 2.4 below) or Operator’s Proposal, Operator covenants to City such team is the same team that will be included to provide the Services under this Agreement (the “Contract Team”). Operator agrees that changes to the Contract Team shall only be made after written request by Operator to the Chief Executive Officer and shall be subject to the Chief Executive Officer’s prior written approval. If written request for such a change is made, Operator shall provide any documentation requested by the Chief Executive Officer for review and approval. Any such request for changes to the Contract Team may be disapproved by the Chief Executive Officer, but such disapproval shall not be exercised so as to unreasonably deprive Operator of its right to make appropriate work assignments. Except as otherwise specifically authorized in this Agreement (including the Scope of Services or the Business and Operations Plan), Operator shall not subcontract for the performance of any of the Services to be provided by Operator under this Agreement without the Chief Executive Officer’s prior written consent, which consent may be granted or denied in the Chief Executive Officer’s reasonable discretion.

Staffing and Personnel. 5.8.1 Supervisors - The Contractor shall designate in writing to the District’s Supervisor, the name of the person assigned as the Contractor’s Project Manager with full authority to administer the terms of this contract. The Contractor’s Project Manager shall have the capability to receive complaints by telephone, pager, or e-mail to facilitate timely corrective actions. An answering service or answering machine shall NOT be an acceptable means of contact for the Contractor’s Project Manager. This representative shall be available Monday through Friday 7:30 AM through 5:00 PM, and provide the District with an emergency after-hours phone number. The Contractor’s Project Manager shall be the contract supervisor. One working supervisor is required during all shifts. The working supervisors shall verify the cleanliness of facilities prior to releasing Contractor personnel each day.
5.8.2 Contractor shall meet in conference with the District’s Supervisor or designee at a time to be specified for administration of work, including review of inspection reports if requested. (District staff will be responsible for completing weekly inspection reports on all facilities).
5.8.3 At a minimum, inspection reports for the previous one-month period shall be provided to the District’s Supervisor, or designee and the Contractor’s Project Manager by the 5th day of the following month.
5.8.4 Personnel - Personnel employed by the Contractor shall be competent, trustworthy and properly trained for the work requirements. The Contractor and employees shall be required to comply with all applicable regulations of the District, as directed, and full cooperation shall be expected and required at all times. Contractor shall notify the Supervisor immediately in writing of all changes on contract personnel by submitting name and address of employee and effective date of employment or termination. When in the opinion of the District, an employee does not constitute a satisfactory security risk, his/her employment on the contract will be denied.

Within ten (10) Days of execution of this Agreement, Construction Manager shall provide to Owner a list of necessary personnel to assist in performing Preconstruction Services on the Project. Personnel to be utilized during the Construction Phase shall be included in Attachment 8 to the Final Guaranteed Maximum Price Amendment. Construction Manager represents and warrants to Owner that it and its employees, and its Subcontractors are experienced in providing the Preconstruction Services required under this Agreement. Construction Manager understands the complexity involved in this type Project and the necessity of coordinating its services and its Work with the Owner, Architect, Project Manager, and Authorities Having Jurisdiction.

The Macomb County Sheriff’s Department will retain control of the employees assigned by the County to provide dispatch services, including but not limited to the standard of performance, discipline of dispatchers, and all other matters incident to the performance of such services. Changes to either the Management Staff or the key staff assigned to this Contract shall only be made after written request by Contractor to the Chief Executive Officer and shall be subject to the Chief Executive Officer’s prior written approval. Staffing and Personnel. C.5.3.1 The Contractor shall provide services in all three regions of the DC Early Intervention Program. The Contractor shall not focus on one particular region.
C.5.3.2 The Contractor shall submit, at the time of application, proof of licensure, education, National Provider Identification (NPI), resume and valid driver’s license for each employee/sub-contractor. The individual staff certifications must show that early interventionists meet the licensure requirements for their respective position as outlined in the Strong Start DC EIP Practice Manual.
C.5.3.3 The Contractor shall submit proof of licensure or certification, education, NPI, resume, and valid driver’s license for each new employee/contractor no more than seven calendar days from the new hire’s start date. New hires shall not provide services until all training has been completed and credentialing documents received and approved in SSCFDS.
C.5.3.4 The Contractor shall provide early interventionists who have obtained and passed criminal background checks and tuberculosis (TB) screening prior to providing services in accordance with Federal and District of Columbia laws and regulations. The Contractor shall ensure that the employee/contractor file contain proof of negative TB results for each contract year. The Contractor must ensure that all staff background checks are in accordance with the District of Columbia’s Criminal Background Checks for the Protection of Children Act of 2004.
C.5.3.5 The Contractor shall maintain an individual personnel file for each staff member or sub-contractor which will contain the application for employment, professional references, applicable credentials/certifications, records of required medical examinations, criminal background checks and tests for alcohol and illegal substance prior to employment, personnel actions including time records, documentation of all training received, notation of any allegations of professional or other misconduct and the Contractor’s action with respect to the allegations, and date and reason if terminated from employment. All of these personnel materials shall be made available to the Office of Contracting and Procurement and DC EIP upon request.
C.5.3.6 The Contractor shall ensure that all therapists are certified in cardiopulmonary resuscitation (CPR) for infants with 3 months of this agreement. New hires shall obtain the CPR certification with 3 months of the employment/contract start date
