Staff Nurse Vacancies. If the candidates under consideration for the posted position in a unit are from that same unit, the position will be awarded based on seniority. In all other cases, the most senior qualified nurse employed in the Medical Center and applying during the posting period will be given the first opportunity to fill the vacancy, subject to the exception in Section 13.2.1 below.
Staff Nurse Vacancies. The qualified senior nurse employed in the 25 Medical Center and applying during the posting period will be given the first 26 opportunity to fill the vacancy. The most qualified junior nurse applicant may 27 instead be awarded the position, provided the junior nurse (1) has completed the 28 new hire probationary period, and (2) the junior nurse is more qualified for the 29 position based upon (a) qualifications as evidenced by certifications, education or 30 workshop credits, or similar materials, and/or (b) demonstrated abilities as 31 evidenced by satisfactory, exemplary or specialty service in a performance 32 evaluation or other document(s). The Medical Center’s choice of the qualified 33 senior nurse shall not be subject to challenge under the grievance procedure. 1 Notwithstanding the foregoing, if the candidates under consideration for the 2 posted position in a unit routinely work in the same unit as the posted position 3 and are able to fully perform the duties of the job, the position shall be awarded 4 based on seniority.

A nurse who has received a final written warning within six (6) months may be denied a position, unless the nurse has made documented improvement, as determined by the Medical Center, or the nurse, at the time, is in the grievance process. A nurse shall have the right to challenge the decision on documented improvement at the time of the denial if they feel they have been unreasonably denied prior to the position being awarded.

In all other 17 cases, if more than one applicant for the position meets the minimum qualifications, the 18 most senior qualified nurse then employed in the Agency who applied during the posting 19 period will be given the first opportunity to fill the vacancy, subject to the exception in 20 Section 13.2.1 below.
