SPECIFICATION OF GOODS. 5.1. No description, specification or illustration contained in any product pamphlet or other sales or marketing literature of the Supplier and no representation written or oral, correspondence or statement shall form part of any Agreement, except the Quote Document.
SPECIFICATION OF GOODS. The Supplier is obliged to supply the Customer with goods of quantity, kind and technical specification as defined in this Contract. The Goods must be new, not used, not damaged, fully functional, top quality provided by the manufacturer of the Goods and in compliance with all licences and rights needed for their proper and problem-less operation and use by the Customer. The Goods must meet all requirements set out by the relevant legal provisions, hygienic, health, safety, technical, as well as any other similar standards for these Goods (hygienic, health, safety, technical, as well as any other similar standards hereinafter the “Standards”). The Goods must pass all attests and approvals necessary for proper and problem-less operation and use. The Goods must not be encumbered by any rights of third parties including chattels mortgages and must be free of any legal or material defects. The Supplier declares that there are no legal provisions, Standards neither any rights of third parties hindering the Customer in proper and problem-less operation and use of the Goods.

The Seller is entitled to ship the type of Goods as mentioned in Clause 4.1, and the Buyer shall accept the Goods stipulated therein.
SPECIFICATION OF GOODS. C-MAC and Projectavision will mutually agree as to the specification of the goods which will be delivered under any order pursuant to the terms of this Agreement. The specification will be Identified in the purchase order and the goods delivered will comply to the specification. C-MAC may, at its sole discretion and without notice to Projectavision, make any change to the goods sold under a purchase order issued pursuant to this Agreement which does not affect the goods form, fit or function. If the change does affect form, fit, or function, C-MAC agrees to notify Projectavision and C-MAC agrees not to ship any goods which have been changed without Projectavision's approval. C-MAC agrees to use reasonable efforts to notify Projectavision prior to C-MAC implementing any changes which do not affect the good's form, fit or function.
