Special Use Permit. The Owner agrees to the following conditions of a Special Use Permit granted by Article II Section 3 of this Agreement, which will allow an asphalt blending, storage and distribution plant in the IN, Industrial zoning district as an “Other Industrial Use” which is permitted by Urbana Zoning Ordinance Table IV-1.

Special Use Permit. The Corporate Authorities agree with this annexation agreement to grant a Special Use Permit to allow the Owners to establish an asphalt blending, storage and distribution plant on Tract “A” under the “All Other Industrial Usesland use category in the IN, Industrial Zoning District. The Corporate Authorities further agree that the granting of the Special Use Permit is consistent with the established criteria identified in Section VII-6 of the Urbana Zoning Ordinance in that the use of an asphalt plant:

Special Use Permit. Through this annexation agreement the Corporate Authorities hereby grant the Urbana Zoning Administrator with the authority to issue a Special Use Permit to allow the Owners to construct a recycling center on the subject property and zoned IN, Industrial Zoning District, subject to the conditions specified in Article I, Section 4. Furthermore, the Corporate Authorities find that granting of the Special Use Permit is consistent with the established criteria identified in Section VII-4 of the Urbana Zoning Ordinance in that this use:
Special Use Permit. We operate the Marina under a special use permit with USDAFS. If that special use permit is for any reason or no reason terminated or amended as to any portion of the Marina, then at our sole option we may terminate this Agreement and revoke the License upon Notice to you, and the termination will be effective on the date specified in the Notice.

Furthermore, the Corporate Authorities find that granting of the Special Use Permit is consistent with the established criteria identified in Section VII-4 of the Urbana Zoning Ordinance in that these uses:
Special Use Permit. The term ‘‘special use permit’’ means the Special Use Permit issued December 1, 1993, by the Secretary to Sandia Peak Tram Company and Sandia Peak Ski Company.
