Special Education Assignments. A. Ohio law requires that all special education class assignments shall maintain intervention specialist and related services personnel/pupil ratios in compliance with the Ohio Operating Standards for Ohio Educational Agencies Serving Children With Disabilities (3301-51-09) (hereinafter referred to as “Operating Standards”). If the Ohio Department of Education adopts legislation or regulations which mandate changes in the service provider ratios for delivery of services (3301-51-09(1)) the parties shall reopen good faith negotiations in this section of the contract (Article 10, Section 3) regarding the impact on terms and conditions of employment. Special Education Assignments. 26 A. All special education teachers shall have six (6) release days during the school year 27 for I.E.P.’s or for the purpose of completing documents and records (not to include 1 participating in staff development activities.) For three (3) of these days, in lieu of 2 release the employee may be compensated at the regular substitute daily rate.
Special Education Assignments. 14.4.1 Unit members assigned to the Special Education department who are interested in a different assignment for the coming year may submit a transfer request form at any time to both the Director of Special Education and Human Resources to be considered for any assignment for which they are credentialed. If the situation is not remedied within twenty (20) working days after being brought to the CEO’s attention, the CTU may take the matter directly to expedited arbitration. If the State of Ohio adopts legislation or regulations which mandate changes in the design of Special Education pro- grams relating to the number of identified students receiving instructional services at any one time by the teacher, the par- ties shall reopen good faith negotiations regarding the impact on terms and conditions of employment. If the administration in a building cannot meet the limits set forth above in one or more classrooms or units, the Principal shall submit the data to the appropriate Regional Superintendent who will attempt to solve the problem by ADM-1 week. The Board shall make a conscientious effort to provide all special education classes 3 (RSP and special day classes, excluding special day G.A.T.E. classes) with adequate 4 space, facilities, and equipment, subject to State funds being available for these 5 purposes.

Special Education Assignments. Unit members assigned to work with Special Education inclusion students shall be provided with training that is relevant to the employee’s assignment as identified in the student’s IEP and the student’s disability. Such training shall include appropriate instructional strategies, specialized health care needs, pupil management and the like.
