HEALTH FUND 1. The Employer shall make contributions to a health trust fund, known as the “Building Service 32BJ Health Fund,” to cover employees covered by this Agreement who work more than two (2) days per week, with such health benefits as may be determined by the Trustees of the Fund. The Employer may, unless rejected by the Trustees, upon execution of a participation agreement in the form acceptable to the Trustees, cover such other of its employees as it may elect, provided such coverage is in compliance with law and the Trust Agreement. Employees who are on workers’ compensation or who are receiving statutory short term disability benefits, Building Service 32BJ long term disability benefits, or a Building Service 32BJ disability pension, shall be covered by the Health Fund without employer contributions until they may be covered by Medicare or thirty (30) months from the date of disability, whichever is earlier. In no event shall any employee who was previously covered for health benefits lose such coverage as a result of a change or elimination of the Health Fund provision extending coverage for disability. In the event the provision extending coverage for disability is discontinued for any reason, the Employer shall be obligated to make contributions for the duration of the period that would have otherwise been available.
Federally Qualified Health Centers (A) The Contractor shall not restrict an Enrollee’s right to obtain FQHC services outside the PMHP through the Fee For Service Medicaid program.

Health Spending Account contributions by the Executive will cease on the Effective Date. The Executive may submit claims against the balance accrued to the Effective Date, until the end of the calendar year in which the Effective Date occurs.

Hospital Central Agreement March The duration of such supernumerary appointments will be for the period of funding (currently months) or such other period as the local parties may agree; Such nurses will not be permitted to transfer out of the supernumerary position on the unit for the duration of the supernumerary appointment; Such nurses can apply for posted positions after the probationary period is completed but cannot transfer until completion of the supernumerary appointment; If the nurse has not successfully posted into a permanent position by the end of the supernumerary appointment, will be reclassified as casual part-time and this will not be considered a lay-off and the nurse will not be reassigned; The Hospital bears the onus of demonstrating that such positions are supernumerary; The Association will be provided with such written information as it may reasonably require regarding each supernumerary position; In the event of a layoff in the area of assignment of the supernumerary nurse, either the Hospital or the Local Association may require that the supernumerary nurse shall be first laid off. SUPPLANTING GOVERNMENT FUNDS 18 CONTRACTOR shall not supplant any federal, State, or COUNTY funds intended for the 19 purposes of this Agreement with any funds made available under this Agreement. 20 CONTRACTOR shall not claim reimbursement from COUNTY for, or apply sums received from 21 COUNTY with respect to, that portion of its obligations which have been paid by another source 22 of revenue. CONTRACTOR agrees that it shall not use funds received pursuant to this Agreement, 23 either directly or indirectly, as a contribution or compensation for purposes of obtaining federal, 24 State, or COUNTY funds under any federal, State, or COUNTY program without prior written 25 approval of ADMINISTRATOR.
Indigenous Peoples 8. The Borrower shall ensure, or cause the Project Executing Agency and Project Implementing Agency to ensure, that the Project does not have any indigenous peoples impacts, within the meaning of the SPS. In the event that the Project or any Subproject does have any such impact, the Borrower shall take, or cause the Project Executing Agency or Project Implementing Agency to take, all steps required to ensure that the Project or Subproject complies with the applicable laws and regulations of the Borrower and with the SPS.
