SORTING AND SEPARATION OF REFUSE AND TRASH. 58.01 Tenant shall, at Tenant's expense, remove all Tenants’ rubbish and trash to such area of the building and at such time as Landlord shall designate, at Tenant’s sole cost and expense. Tenant covenants and agrees, at its sole cost and expense, to comply with all present and future laws, orders and regulations of all state, federal, municipal and local governments, departments, commissions and board regarding the collection, sorting, separation and recycling of waste products, garbage, refuse and trash. Tenant shall sort and separate such waste products, garbage, refuse and trash into such categories as provided by law. Each separately sorted category of waste products, garbage and trash shall be placed in separate receptacles reasonably approved by Landlord. Such separate receptacles may at Landlord's option, be removed from the Demised Premises in accordance with a collection schedule prescribed by law. Landlord reserves the right to refuse to collect or accept from Tenant any waste products, garbage, refuse or trash, which is, not separate and sorted as required by law and to require Tenant to arrange for such collection, at Tenant's sole cost and expense utilizing a contractor approved by Landlord. Tenant shall pay all costs, expenses, fines, penalties or damages which may be imposed on Landlord or Tenant by reason of Tenant's failure to comply with the provisions of this Article, and, at Tenant's sole cost and expense, shall indemnify, defend and hold Landlord harmless, including legal fees and expenses) from and against any actions, claims suits arising from such non-compliance, utilizing counsel reasonably satisfactory to Landlord.

Resident shall sort and separate such items into categories as provided by law, and in accordance with the rules and regulations adopted by Owner for the sorting and separating of such designated recyclable materials.

TENANT's Duties: TENANT agrees, at TENANT's sole cost and expense, to comply with all present and future laws, orders, and regulations of all federal, state, municipal, and local governments, departments, commissions, and boards (including the Board of Directors of the Association of Apartment Owners of the Project) regarding the collection, sorting, separation, and recycling of waste products, garbage, refuse, and trash. TENANT shall sort and separate such items into categories as provided by law or as otherwise required, and in accordance with the rules and regulations adopted by any or all of the aforementioned named entities for the sorting and separating of such designated recyclable materials.

SORTING AND SEPARATION OF REFUSE AND TRASH. Tenant shall, at its sole cost and expense, comply with all present and future Legal Requirements regarding the collection, sorting, separation and recycling of waste products, garbage, refuse and trash. Tenant shall sort and separate such waste products, garbage, refuse and trash into such categories as provided by Legal Requirements. If and to the extent required by the applicable Legal Requirements, each separately sorted category of waste products, garbage and trash shall be placed in separate receptacles. Tenant shall pay all costs, expenses, fines, penalties or damages which may be imposed on Landlord or Tenant by reason of Tenant's failure to comply with any of the provisions of this Section 22.F. and, Tenant, at Tenant's sole cost and expense, shall indemnify, defend and hold Landlord harmless (including reasonable attorneys' fees and expenses) from and against any actions, claims and suits arising from such non-compliance.

Such separate receptacles shall be removed from the Premises in accordance with a collection schedule prescribed by law or by Landlord.

  • ATTACHMENT A Equity Funds This document is an attachment to the Participant Agreement with respect to the procedures to be used by (i) the Distributor and the Transfer Agent in processing an order for the creation of Shares, (ii) the Distributor and the Transfer Agent in processing a request for the redemption of Shares and (iii) the Participant and the Transfer Agent in delivering or arranging for the delivery of requisite cash payments, Portfolio Deposits or Shares, as the case may be, in connection with the submission of orders for creation or requests for redemption. Service Provider shall keep the current contracts with the Vendors and the ITT CORPORATION SALARIED MEDICAL AND DENTAL PLAN (PLAN NUMBER 502 EIN 00-0000000) and the ITT Salaried Medical Plan and Salaried Dental Plan General Plan Terms (collectively, the “Plans”) and all coverage thereunder in full force through December 31, 2011 for Service Recipient’s Covered Employees. All claims of Service Recipient’s Covered Employees made under the Plans and incurred on or prior to December 31, 2011 the (“2011 Plan Year”) will be adjudicated in accordance with the current contract and Service Provider will continue to take such actions on behalf of Service Recipient’s Covered Employees as if such employees are employees of Service Provider. All medical, dental, pharmacy and FSA claims of Service Recipient’s Covered Employees made under the Plans (the “Claims”) will be paid by the Vendors on behalf of the Service Provider. Service Recipient will pay Service Provider for coverage based on 2011 budget premium rates previously set for the calendar year 2011 and described in the “Pricing” section below. Service Recipient will pay Service Provider monthly premium payments for this service, for any full or partial months, based on actual enrollment for the months covered post-spin using enrollments as of the first (1st) calendar day of the month, commencing on the day after the Distribution Date. Service Provider will conduct a Headcount True-Up (as defined below) of the monthly premiums and establish an Incurred But Not Reported (“IBNR”) claims reserve for Claims incurred prior to December 31, 2011 date, but paid after that date, and conduct a reconciliation of such reserve.
