Sole Warranty. THE SOLE WARRANTY, IF ANY, PROVIDED BY AOS IN CONNECTION WITH THE PRODUCT SHALL BE TO THE DISTRIBUTOR. AOS MAKES NO WARRANTIES TO THE CUSTOMERS.
Sole Warranty. This Section 5 is the only warranty by or on behalf of Seller and may not be modified or amended except in writing signed by an Officer of Seller and by Buyer. Buyer is not relying upon any warranty or representation except for those specifically stated here or in such a signed writing.
Sole Warranty. THE WARRANTIES IN SECTIONS 6 AND 10 CONSTITUTE SELLER'S SOLE AND EXCLUSIVE WARRANTIES WITH RESPECT TO THE GOODS AND ARE IN LIEU OF AND EXCLUDE ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE, INCLUDING WITHOUT LIMITATION, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WHETHER OR NOT THE PURPOSE OR USE HAS BEEN DISCLOSED TO SELLER IN SPECIFICATIONS, DRAWINGS OR OTHERWISE, AND WHETHER OR NOT SELLER'S GOODS ARE SPECIFICALLY DESIGNED AND/OR MANUFACTURED BY SELLER FOR BUYER'S USE OR PURPOSE.
Sole Warranty. Except as set forth in Section 2.1 and Section 13.4(a), (a) the Warranties provided in this Article 21 shall be Contractor's sole warranty with respect to the Work and the Facility and (b) Contractor does not make (and hereby expressly disclaims) any other warranties of any kind whatsoever.
Sole Warranty. 9.04.01 WITH RESPECT TO TI PRODUCTS, THE WARRANTY SET FORTH IN SECTION 9.01 STATES ANAM'S AND AMKOR'S SOLE WARRANTY, AND SECTION 9.02.01 STATE TI'S SOLE REMEDIES FOR THE BREACH OF SUCH WARRANTY.

Seller warrants, and only warrants, that the Styrene shall meet Specification (except with respect to Off-Spec Styrene which Buyer agrees to purchase), that Seller shall have the right to sell Styrene and that Seller shall convey the Styrene at the time of delivery at the Delivery Location with good and marketable title,
Sole Warranty. Mercury will warrant any Product purchased hereunder in accordance with, and only to the extent expressly provided in, Mercury’s standard warranty provisions applicable to Products at the time that the Product in question was purchased by Company (the “Warranty”). Such Warranty shall be for the exclusive benefit of Company’s distributors and customers thereof. THE APPLICABLE WARRANTY CONSTITUTES MERCURY’S SOLE AND EXCLUSIVE WARRANTY WITH RESPECT TO ANY PRODUCT PURCHASED HEREUNDER. EXCEPT TO THE EXTENT EXPRESSLY STATED OTHERWISE IN THE APPLICABLE WARRANTY, MERCURY HEREBY DISCLAIMS ALL EXPRESS WARRANTIES (WHETHER ORAL OR WRITTEN) AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURCHASE, AND ALL WARRANTIES ARISING BY CUSTOM OR TRADE USAGE.
Sole Warranty. THE ONLY WARRANTY ASSOCIATED WITH YOUR SUBSCRIPTION IS THE SOLAR GARDEN PRODUCTION GUARANTY ATTACHED HERETO AS EXHIBIT A. UNLESS SPECIFICALLY SET FORTH HEREIN, TO THE FULLEST EXTENT ALLOWED UNDER APPLICABLE LAW, YOU WAIVE ALL OTHER GUARANTIES AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY. WITHOUT LIMITATION, YSG DOES NOT REPRESENT OR WARRANT, ON AN EXPRESS OR IMPLIED BASIS, AS TO THE MERCHANTABILITY, FITNESS FOR ANY PURPOSE, CONDITION, DESIGN, CAPACITY, SUITABILITY OR PERFORMANCE OF THE SOLAR GARDEN OR ITS INSTALLATION OR THAT THE VDER CREDITS WILL BE DELIVERED BY YOUR ELECTRIC UTILITY. YSG HEREBY DISCLAIMS, AND YOU HEREBY WAIVE, ANY WARRANTY WITH RESPECT TO ANY COST SAVINGS FROM THE VDER CREDITS.
Sole Warranty. THIS LIMITED WARRANTY IS GIVEN AND ACCEPTED IN PLACE OF (i) ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE; AND (ii) ANY OBLIGATION, LIABILITY, RIGHT, CLAIM OR REMEDY IN CONTRACT OR IN TORT, INCLUDING PRODUCT LIABILITIES BASED UPON STRICT LIABILITY, NEGLIGENCE, OR IMPLIED WARRANTY IN LAW. This Limited Warranty is the only warranty made by Warrantor. Purchaser’s sole remedy for a breach of this Limited Warranty or any defect in a part is the repair or replacement of any defective Product.
Sole Warranty. Response warrants (the “Sole Warranty”) that, at the time the Raw Materials are delivered to JBT, the Raw Materials will meet the specifications agreed pursuant to the Collaboration Agreement and the QC Acceptance Criteria agreed pursuant to Section 2.7 above. The Sole Warranty is in lieu of all other warranties, express or implied, including but not limited to the warranty of fitness for a particular purpose and the warranty of merchantability. Response will make no warranties or representations concerning the Raw Materials other than the Sole Warranty. In the event of a breach of the Sole Warranty, Response will be obligated, at its sole option, to either (i) replace the Raw Materials that do not meet the Sole Warranty and in any such case [***], or (ii) reimburse JBT an amount equal to the amount paid by JBT for such Raw Materials, by credit against Firm Orders of the following first shipment of same Raw Materials. Response will send to JBT either a return goods authorization (RGA) form or instructions regarding destruction of, such non-conforming Raw Materials. Raw Materials may not be returned to Response for any reason other than the breach of Sole Warranty.
