Single Fund. All assets of the Trust Fund and of each investment fund, and the income thereon, shall be held and invested as a single fund and the Trustee shall not make any separate investment of the Trust Fund, or make any separate investment fund, for the account of any Participant or other General Creditors prior to receipt of directions to make payments to such Participant or other General Creditors in accordance with Section 6 or Section 7. All rights associated with assets of the Trust shall be exercised by the Trustee or the person designated by the Trustee, and shall in no event be exercisable by or rest with Participants. SECTION 6

Single Fund. The assets of the Pool shall be deemed a single commingled fund held for the benefit of the members. There shall not be any member accounts.
Single Fund. The assets of the Trust shall be held, administered, invested and managed in all respects as a single trust even though portions of such assets may be attributable to different employers and the employees of each, or to separate plans maintained by the same employer or different employers. The Subtransfer Agent shall be responsible to maintain and determine the appropriate share of the Trust fund held in respect of any such group of employees in the event that such maintenance or determination shall be required by the Plan, this Agreement or the operation of law. The determination by the Sponsor of the shares of the Trust fund held in respect of any such employee group or plan shall be final and conclusive upon all persons.
