The exceptions to the above are cases in which the Employer receives a report of a complaint, concern or accident from a member of the public or automated notice from the GPS system regarding a bargaining unit member. In those cases, if the Employer review recorded data and determines there may be a basis for potential discipline, it will notify the Union. The Union has the right to request relevant material related to the potential discipline. Any finding of misconduct resulting in discipline must be related to the specific incident which was the subject of the complaint, stated concern, accident or automated notice for the GPS system. In these cases, all relevant provisions of this Agreement, including all provisions related to just cause, due process, and progressive discipline, shall apply.
