Shipment of Product. Formosa will not ship any API to any destination on behalf of NGX until NGX has released the API and authorized shipment or unless prior approval has been received from NGX to perform such shipments. Shipment of Product to ORPHAN - Only approved, finished (unless required by ORPHAN), labeled PRODUCTS will be shipped by C*P to ORPHAN. Any shipment of product from C*P which is Unapproved or under Quarantine requires prior written consent by the ORPHAN’S Quality Unit. This authorization will be on a lot by lot basis.
Shipment of Product. Pharmacy shall label all product on a patient specific manner and ship product directly to provider, at the DEA address denoted by provider on the Order Form, who will be administering the product. Tracking of product from pharmacy to implant location will be monitored.
Shipment of Product. EDT shall ship, or cause to be shipped, at SM’s expense, the Product to SM or such destination(s) as SM may designate in writing. Komag may ship, determine freight forwarder, and provide delivery support by the method it deems most advantageous. WDC shall ensure that the freight forwarder selected by Komag may use WDC's "Manufacturer's Export Status" for shipments on behalf of WDC to Thailand, so long as the parties mutually agree. Transportation charges are included in the Unit Price. Komag shall deliver, upon request from WDC, appropriate import certificates for duties paid on Media purchased from Komag, imported by Komag into the United States and delivered to WDC in the United States.

Shipment of Product. Shipment of Product will be to the distribution center(s) designated by Celsion in China. Hisun will not make direct shipments to final customers. Celsion will select and pay the carrier to be used. Product will be shipped, per Specification, FOB Shanghai, China, freight class, Class 70 (Class of Commodity for Food and Pharmaceutical Product), or as may otherwise be required pursuant to Applicable Laws and Product storage specifications. All Product shipped by Hisun shall be clearly marked for delivery to the Celsion or customer locations as Celsion may designate. Hisun shall ship all Product in accordance with the instructions specified in Celsion’s purchase order. A Certificate of Analysis (“COA”), a form of which is attached hereto as Schedule 4.4, specific to the testing of each lot/batch, must accompany each shipment. Hisun shall maintain a copy of each such COA in compliance with GMP. Hisun shall provide a duplicate copy of the COA, a commercial invoice and an airway xxxx with each shipment. Title and risk of loss or damage to the Product will remain with Hisun until it reaches the distribution center designated by Celsion in Shanghai, China, at which time title to the Product will rest in, and risk of loss or damage to the Product will pass to, Celsion FOB Shanghai, China.
