Common use of Shareholder Liability Clause in Contracts

Shareholder Liability. The Distributor is hereby expressly put on notice of the limitation of shareholder liability as set forth in the Declaration of Trust of the Fund and agrees that obligations assumed by the Fund pursuant to this Agreement shall be limited in all cases to the Fund and its assets. The Distributor agrees that it shall not seek satisfaction of any such obligation from the shareholders or any individual shareholder of the Fund, nor from the Trustees or any individual Trustee of the Fund.

Shareholder Liability. The Distributor is hereby expressly put on acknowledges that it has received notice of and accepts the limitation limitations of shareholder liability as set forth in the Fund's Agreement and Declaration of Trust of the Fund and Trust. Distributor agrees that the Fund's obligations assumed by the Fund pursuant to this Agreement hereunder shall be limited in all cases to the Fund and its assets. The Distributor agrees that it shall not seek satisfaction of any such obligation from the shareholders or any individual shareholder of the Fund, nor from and that Distributor shall have recourse solely against the Trustees assets of the Portfolio with respect to which the Fund's obligations hereunder related and shall have no recourse against the assets of any other Portfolio or against any individual Trustee shareholder, Trustee, officer, employee, or agent of the Fund.

The Distributor agrees that it shall not seek satisfaction of any such obligation from the shareholders or any individual shareholder of the Fund, nor from the Trustees Directors or any individual Trustee Director of the Fund.

The Distributor agrees that it shall not seek satisfaction of any such obligation from the shareholders or any individual shareholder of the Fund, nor from and that Distributor shall have recourse solely against the Trustees assets of the Portfolio with respect to which the Fund's obligations are hereunder related and shall have no recourse against the assets of any other Portfolio or against any individual Trustee shareholder, Trustee, officer, employee, or agent of the Fund.
