Common use of Settling of Grievances Clause in Contracts

Settling of Grievances. Should any question arise concerning the application, interpretation, or an alleged violation of the provisions of this Agreement, between the Employer and the employee or group of employees and where the employee has the written consent of the Union the following procedure shall apply: STEP ONE: Within twenty (20) working days after the alleged grievance has arisen, the employee, accompanied by a member of the grievance committee and a representative of the Union if he so desires, may take the matter up with the Director of Human Resources presenting the grievance in writing, on forms agreed upon by the Employer and the Union. Failing any written reply or satisfactory settlement within ten (10) working days, the employee may proceed to Step Two. STEP TWO: Within ten (10) working days from the expiration of the ten-day (10) period referred to in Step One, the employee, accompanied by a representative of the Union if so desired, may take the matter up with the Superintendent. The form completed on Step One must be presented. The Superintendent shall reply in writing on such form within ten (10) working days from the presentation of the grievance under Step Two. Failing any written reply or satisfactory settlement within such ten-day (10) period, the matter may be referred to adjudication as provided in Article 15 (Adjudication) hereof within twenty (20) working days from the expiration of such ten-day (10) period.
