Common use of Servicing of the Loan Clause in Contracts

Servicing of the Loan. Pursuant to the Servicing Agreement, the Master Servicer (whose identity may change from time to time as provided in the Servicing Agreement) will be appointed as the servicer of the Mortgage Loan and the Special Servicer (whose identity may change from time to time as provided in the Servicing Agreement) will be appointed as the special servicer of the Mortgage Loan, and the parties agree that the Master Servicer and Special Servicer will service the Mortgage Loan on behalf of each Noteholder pursuant to the Servicing Agreement and subject to the terms hereof. The Senior Noteholders shall not enter into any amendment to any Servicing Agreement that would materially and adversely affect the rights or interests of the other Noteholders without obtaining such other Noteholders’ prior written consent which consent may be withheld in such other Noteholders’ sole and absolute discretion.
