Service Outside the Bargaining Unit. (a) An employee who leaves the Union and subsequently returns shall be treated as a new employee from the date of his/her return except as otherwise provided in this Agreement.

Service Outside the Bargaining Unit. An Employee who accepts a position with Berlitz outside of the bargaining unit shall maintain seniority for a period not to exceed ninety (90) days. Should the Employee decide during this ninety day period, that he/she does not want to continue in the position, the Employee may return to the bargaining unit. Upon expiry of the ninety day period, and continuation of the Employee in the position outside of the bargaining unit, the Employee shall lose all his/her seniority under this Agreement.

Upon a decision by the Parties or the Labour Relations Board of British Columbia, or any of its successors, that a person and a job previously excluded from the bargaining unit shall henceforth be included in the bargaining unit, the person involved, at their option, may be granted seniority credit for some or all of the period of the exclusion, provided it is approved by the Union and provided the person exercises such option in writing to the Union within thirty (30) calendar days of the date of entry into the bargaining unit. Seniority achieved under this Clause 9.05(b) shall not be used to secure any promotion in accordance with Article 14 during the first six (6) months from the date of entry into the bargaining unit; or to exercise any bumping rights under Article 19 during the first twelve (12) months from the date of entry into the bargaining unit.
