SEPARATE CONTRACT. This Agreement is separate and distinct form, and neither affects nor is affected by (i) the Fund's Distribution Agreement, and (ii) the Fund's Administrative Services Agreement. Nothing contained in this Agreement shall prevent the Adviser or any affiliated person of the Adviser from acting as investment adviser or manager for any other person, firm, corporation, or other entity and shall not in any way bind or restrict the Adviser or any such affiliated person from buying, selling, or trading any securities, commodities, futures contracts, or options on such contracts for their own accounts or for the account of others for whom they may be acting. Nothing in this Agreement shall limit or restrict the right of any director, officer, or employee of the Adviser to engage in any other business or to devote his time and attention in part to the management or other aspects of any other business whether of a similar or dissimilar nature.
SEPARATE CONTRACT. This Agreement is separate and distinct from, and neither affects nor is affected by (i) the Distribution Agreement in effect between the Fund and Navellier Securities Corp., a Delaware Corporation, or (ii) the Investment Advisory Agreement in effect between the Adviser and the Fund.
SEPARATE CONTRACT. 33.1 The Contractor shall coordinate his operations with those of other Contractors. Cooperation will be required in the arrangement for the storage of materials and in the detailed execution of the work. The Contractor, including his subcontractors, shall keep informed of the progress and the detail work of other Contractors and shall notify the Architect/ Engineer immediately of lack of progress or defective workmanship on the part of other Contractors. Failure of a contractor to keep informed of the work progressing on the site and failure to give notice of lack of progress or defective workmanship by others shall be construed as acceptance by him of the status of the work as being satisfactory for proper coordination with his own work.
SEPARATE CONTRACT. Each time that an Order Confirmation or Quote is accepted by you, a separate contract is formed between the Parties for the supply of the Goods and Services (each an Order) as set out in the Order Confirmation or Quote.
SEPARATE CONTRACT. All extracurricular assignments as mutually agreed upon and listed on the index system shall be written into a separate contract at contract time and will not be changed unless there is mutual agreement among the Board, Superintendent and the teacher.
SEPARATE CONTRACT. A contract between Metro and a party other than Contractor for the construction or furnishing of a portion of the Project.
SEPARATE CONTRACT. Participant acknowledges and agrees that PSE is not, and shall not be deemed to be, a party to any purchase or installation contract relating to Conservation Measures, which shall be installed pursuant to a respect to any aspect of the Conservation Measures is limited to the furnishing of the Grant. PSE HAS NOT MADE AND DOES NOT MAKE (AND PARTICIPANT ACKNOWLEDGES THAT PSE DOES NOT MAKE) ANY IMPLIED OR EXPRESS WARRANTY (INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS) REPRESENTATION, OR PROMISE WITH RESPECT TO EITHER (A) THE CONSERVATION MEASURES, (B) ANY MATERIALS AND LABOR REQUIRED FOR OR USED IN THE INSTALLATION OF THE CONSERVATION MEASURES, OR (C) THE INSTALLATION OF THE CONSERVATION MEASURES.
SEPARATE CONTRACT. It is understood and agreed by the parties that, unless otherwise expressly provided in a particular Engagement Schedule or Engagement Schedules, each Engagement Schedule (as it is supplemented and amended by the terms and conditions of this Agreement) shall be deemed a separate contract by and between GENERAL AMERICAN and LIS. Unless the context indicates otherwise, any reference in an Engagement Schedule or this Agreement to an "Engagement Schedule" shall, accordingly, be deemed to refer solely to the relevant Engagement Schedule (and any schedules, attachments or addenda to that particular Engagement Schedule), as supplemented and amended by the terms and conditions of this Agreement. Any reference to "the Agreement" shall be deemed to refer (unless expressly otherwise so provided) to the relevant Engagement Schedule (which incorporates the terms and conditions of this Agreement).

Unless the context indicates otherwise, any reference in this Agreement to an Exhibit or Work Assignment shall, accordingly, be deemed to refer solely to the relevant Exhibit or Work Assignment (and any schedules, attachments or addenda to that particular Exhibit or Work Assignment), as supplemented and amended by the terms and conditions of this Agreement. For so long as any Exhibit or Work Assignment remains in effect, the terms and conditions of this Agreement shall continue to remain in effect with respect to the Services covered by said Exhibit or Work Assignment.
