SEPARABILITY AND SAVINGS. 24.1 A. If any provision of this Agreement or any application of this Agreement to any employee employee, member or group of employees or members, is held to be invalid by operation of law or by a Court the decision of any court or other tribunal of competent jurisdiction, then such provision and application shall be inoperative but deemed inoperative. However, all other provisions shall not be affected thereby and applications contained herein shall continue in full force and effect, and shall not be affected thereby.

The parties agree to meet promptly to discuss the impact of the affected contract provision and to create a new provision as may be needed. Such discussions shall not “open” the Agreement during its term.

The parties agree they shall, upon the request of either party, within fifteen workdays subsequent to any such decision, meet for the purpose of negotiating such new terms or conditions required to correct the declaration of invalidity.
