  • Unpaid Leave - Affecting Seniority and Benefits ‌ Any employee granted unpaid leave of absence totalling up to twenty (20) working days in any year shall continue to accumulate seniority and all benefits and shall return to her/his former job and increment step. If an unpaid leave of absence or an accumulation of unpaid leaves of absence exceeds twenty (20) working days in any year, the employee shall not accumulate benefits from the twenty-first (21st) day of the unpaid leave to the last day of the unpaid leave but shall accumulate benefits and receive credit for previously earned benefits upon expiration of the unpaid leave.

  • President’s Leave The Employer shall authorize a leave of absence with pay for the President of the Association. The leave of absence with pay shall be taken for a two-year period beginning two (2) weeks after written notice by the Association to the Bureau of Employee Relations and the newly-elected President’s agency. During such leave of absence with pay, the President shall continue to receive and retain all of his/her wages, rights, benefits, and seniority as a state employee except that all leave accumulation shall be frozen for the duration of the leave of absence. Upon returning from the leave of absence, the President shall resume earning leave at the rates appropriate to his/her service at the time of return. The Employer agrees that there shall be no action taken with respect to the President or the President’s state position prior to or following his/her return from the leave of absence because of his/her legal union activities. The Association agrees to reimburse the Employer for the full cost of the wages and benefits for the President, and to indemnify the Employer against any and all liabilities associated with the leave of absence, including but not limited to workers' compensation.

  • Training Leave An employee appointed or elected as an accredited representative of the union shall, upon application in writing to the employer, be granted up to 5 days leave with pay each calendar year (non-cumulative) to attend appropriate courses: • Such courses shall be designed and structured with the objective of promoting good industrial relations within the building and construction industry. • Consultation may take place between the parties in the furtherance of this objective Accredited representative of the union shall mean a job xxxxxxx recognised by the employer. The following shall apply: Employees covered by Agreement Max. No. of employees to attend per year Xxx. No. of days per year Up to l5 1 5 31-50 3 15 51-100 4 20 101 and over 5 25 The application for leave shall be given to the employer at least 6 weeks in advance of the commencement of the course. The application shall contain the following details: • The name of the employee seeking leave • The period of time for which the leave is sought (including dates and daily commencing and finishing times) and • The title, general description and structure of the course to be attended and the location of where the course is to be conducted. The employer shall advise the union within seven clear working days (Monday to Friday) of receiving the application as to whether or not the application for leave has been approved. The time of taking leave shall be arranged so as to minimise any adverse effect on the employer’s operations. The onus shall rest with the employer to demonstrate an inability to grant leave when an eligible employee is otherwise entitled. An employer shall not be liable for any additional expenses associated with an employee’s attendance at a course, other than the payment of ordinary time earnings for such absence. For the purposes of this clause ordinary time earnings shall be defined as the relevant award classification rate, shift work loadings plus over-award payments. Leave rights granted in accordance with this clause will not result in additional payment for alternative time off to the extent that the course coincides with an employee’s day off in the 19 day month work cycle. An employee on request by their employer shall provide proof of their attendance at any course within 7 days. If an employee fails to provide such proof the employer may deduct any amount already paid for attendance from the week’s pay or any monies due to the employee. Where an employee is sick during a period when leave under this provision has been granted proof of attendance at the course is not required for that period and the employee shall receive payment in accordance with personal leave provisions. Leave of absence granted in accordance with this clause shall count for all purposes of employment.

  • Seniority Frozen When an Agency intends to initiate a layoff, the Agency will notify the Union in writing that all seniority will be frozen from the date of notice for a period not to exceed three (3) months. However, during the period when seniority is frozen, the employee will continue to accumulate time towards seniority for purposes of future computations. The three (3) month freeze may be extended by mutual written agreement of the Union and the Agency.

  • Commencement of Parental Leave Subject to subsection 24.07, Parental Leave in Addition to Maternity Leave, parental leave must commence no later than the first anniversary date of the birth or adoption of the child, or of the date on which the child comes into the actual care and custody of the employee.

  • Maternity Leave and Parental Leave 8.9.1.1 For the benefits of the Employment Standards Act to apply during the statutory periods set out by the Act, employees must ensure that the appropriate certificate indicated in that Act is signed by a duly qualified medical practitioner and submitted to the appropriate Xxxx or Director.

  • Seniority Roster The District shall maintain an updated seniority roster, indicating employee's class seniority and hire date seniority. Such rosters shall be available to CSEA.

  • Medical Care Leave An Employee who is unable to make the necessary arrangements for maintenance of personal health care outside of scheduled work time, shall be granted time off with pay. Such time off shall not exceed sixteen (16) working hours per calendar year. Hours in excess of sixteen (16) hours per calendar year shall be deducted from the Employee's sick leave accumulation.

  • Childrearing Leave 1. Any teacher who has acquired tenure and is expecting a child, or whose spouse is expecting a child, or who has documented plans in the immediate future to adopt or xxxxxx a child of preschool age or a preteen child with special needs or who is non-English speaking, may be granted a long-term leave without pay for child-rearing purposes up to two (2) full semesters or a reasonably requested portion thereof within the same school year.

  • Intermittent Leave If medically necessary due to the serious medical condition of the employee, or that of the employee's spouse, child, parent, registered domestic partner within the meaning of Minneapolis Code of Ordinances Chapter 142, or other dependents and/or members of their households who have a serious medical condition, leave may be taken on an intermittent schedule. In cases of the birth, adoption or xxxxxx placement of a child, family and medical leave may be taken intermittently only when expressly approved by the Employer.
