Seniority Application. Except under extraordinary circumstances, vacations, shifts, shift transfers and regular days off shall be scheduled with due regard for the needs of the agency, seniority, and employee preference. The state and the PBA understand that there may be times when the needs of the agency will not permit such scheduling.
Seniority Application. A. The above terms for determination of seniority shall apply not only to the layoff process, but also to other situations in which seniority is applied, including total service for the purpose of vacation accrual rates.

Seniority Application. Seniority shall operate on a total plant basis except where otherwise provided in this Agreement. Employees may not use their seniority during a short work day to displace a more junior employee if that displacement would result in the payment of overtime that would otherwise not be payable.

Where ability is substantially equal, seniority shall be observed in rehires, transfers and promotions. Seniority shall be the determining factor regarding layoffs and vacation preference per Section 6.3 (b); provided that, in layoffs the remaining employee is qualified to perform the work. Seniority shall continue for a period of one year after a layoff. For rehire, the employee must contact the Employer’s office once a month advising the Employer of availability for work.
