Self-Representation. When an employee covered by this Agreement chooses to self-representation the presentation of a grievance, no adjustment of the grievance will be inconsistent with the terms of this Agreement. Prior to the adjustment of any such grievance, the appropriate Union xxxxxxx will be notified of the right to be present at the adjustment. The grievance step shall not be repeated if the employee chooses to be self-represented.
Self-Representation. A LUC-AAUP representative shall be permitted to represent the grievant and, in any event, to represent and speak on behalf of XXX-XXXX’s particular point of interest in connection with the grievance. In this regard, it is understood that the grievant has the right to represent himself and that XXX-XXXX shall not interfere with that right.
Self-Representation. In the event a grievant elects to file and proceed without Association representation, he/she may do so through the first two (2) steps of the procedure only, provided that the Association is present at every meeting or conference in order to protect its contract rights, and further provided that copies of the grievance, appeals and responses are given to the President in a timely fashion.
Self-Representation. The grievant may elect, in writing, to represent himself/herself rather than have the Union provide representation. If the grievant elects to represent himself/herself at this step, or at any later step, the Union shall be relieved of any further obligation of representation and shall be relieved of any obligation to share in any further expense of the grievance procedure. No resolution shall be inconsistent with the terms of this Agreement.
Self-Representation. The grievant may at any time represent himself/herself in any proceedings. The grievant shall inform the Union President or designee of all meetings to discuss grievances and shall have the right to have a non-participating observer present at all such meetings. In the event that self-representation is invoked by the grievant, the grievant will promptly send to the President of the Union or designee a copy of the filed grievance.
Self-Representation. Any employee in the Unit may file their own 47 problem/grievance as allowed by Section 7121 of the Act, in accordance with Section 48 1905 and may elect to have the problem/grievance addressed without UNION 49 representation. However, the UNION shall be notified of and afforded the opportunity to 50 be present at all discussions between the EMPLOYER and the employee concerning the 51 issue. The EMPLOYER will provide copies of all correspondence to the UNION if no 1 discussions are held. At the appropriate time, the UNION will be allowed to make known 2 its views concerning the problem/grievance. 3 4 Resolutions as a result of self-representation may not be inconsistent with the terms of 5 the AGREEMENT, government wide regulations or law and the UNION must be given the 6 opportunity to be present at the adjustment. If a grievance resolution is not satisfactory to 7 the grievant, the decision to take the grievance forward to binding arbitration is exclusive 8 to the UNION. 9
Self-Representation. Employees covered by this Agreement may request to represent themselves in a grievance hearing; however, no settlement shall conflict with any provision of this Agreement. The Union shall have representatives present during any such hearing.
Self-Representation. Nothing herein shall prohibit an employee from exercising his/her right to self representation under steps one thru three of the grievance procedure, so long as any grievance settlement does not violate the terms of this collective bargaining agreement and a copy of the settlement agreement is provided to the Union, and provided a Union Representative was afforded an opportunity to be present at any settlement conference. The City and the Union may, by mutual agreement in a specific case, agree to utilize an expedited arbitration procedure.
Self-Representation. When an employee covered by this Agreement chooses to be self-represented in the presentation of a grievance, no adjustment of the grievance will be inconsistent with the terms of this Agreement. When an employee covered by this Agreement chooses to forego OPBA representation in the presentation of a grievance, no adjustment of the grievance will be inconsistent with the terms of this Agreement. Prior to the adjustment of any such grievance, the appropriate OPBA Representative will be notified of the OPBA Representative’s right to be present at the adjustment.
