– Selection for Station to Station and/or Shift to Shift Transfers. When a vacancy becomes available for which two (2) or more Emergency Operations employees have requested a transfer, the employee whose transfer request has the earliest applying date shall receive the transfer; provided that if two (2) or more transfer requests for the same vacancy were received dated for the same date, the senior employee shall be transferred. For the ranks up to and including Lieutenant, seniority is determined by their time as a sworn employee of the Fire Department, with ties being broken by final academic standing from recruit training. Seniority for positions above Lieutenant will be broken by time in grade. The applying date shall be the date submitted at the station or location assigned.

  • Presentation for Scaling Purchaser shall present products so that they may be Scaled in an eco- nomical and safe manner. If prior to Scaling, Included Timber is to be mixed with other timber, Purchaser shall, prior to mixing, provide for distinguishing, by means ap- proved by Forest Service, each product included in this contract. Trees or pieces presented for Scaling that have not been bucked to separate material meeting minimum piece standards from material not meeting minimum piece standards due to diameter, shall be Scaled as though such bucking had been done. Deductions made for rot, check, or other defects re- sulting from abnormal delay in Scaling caused by Pur- chaser shall be recorded separately and charged to Xxx- ber Sale Account under B3.47. Any timber that has been removed from Sale Area during the period of this contract, but remains unscaled after Termination Date, shall be Scaled at the earliest rea- sonable date.

  • Notice to State The MCO must notify the STATE of a possible Material Modification in its Provider Network within ten (10) working days from the date the MCO has been notified that a Material Modification is likely to occur. A Material Modification shall be reported in writing to the STATE no less than one hundred and twenty (120) days prior to the effective date or within two (2) working days of becoming aware of it, whichever occurs first. An MCO may terminate a subcontract without one hundred and twenty (120) days’ notice in situations where the termination is for cause. For purposes of this section, termination of a Provider for cause does not include the inability to reach agreement on contract terms.
