Security of cards and PINs. 15.1 It is very important that you or any user keep your card, PIN and password secure. If a user fails to follow the security recommendations set out below, you may increase your liability for any unauthorised use of a user’s card. Please note that these guidelines provide examples only and will not determine your liability for losses resulting from unauthorised EFT transactions on your card account. These will be determined in accordance with condition 16, 17 and the ePayments Code. You and any User must: > sign the back of their card immediately on receipt using a ballpoint pen; > always keep the card in a secure place and check regularly to ensure it has not been lost or stolen; > when a transaction is complete, ensure you have your card and any receipt; > not permit any other person to use the card; > immediately notify us if you become aware or suspect that someone else has used your card, accessed your card account, or your card has been lost or stolen.

Security of cards and PINs. The security of your card and PIN is very important as they allow unrestricted access to the card account and any linked account. You must make every effort to see that your card and any record of your card and PIN are not misused, lost or stolen. If you fail to ensure the security of your card and PIN the Principal’s liability is determined under condition 24.

Your own personal PIN We give you the additional convenience and security of being able personally to select your own PIN (which may be a word or a number). We strongly advise you to select a PIN that you can remember without needing to make a written record of it or anything which reminds you of it. When selecting your own PIN, it must comprise four digits or a word of four letters. Under the next heading, we tell you the PINs you should not select. Can you record a memory aid for your PIN? If you require a memory aid to recall your PIN you may make such a record provided the record is reasonably disguised. However, we do not consider that the following examples provide a reasonable disguise, and you agree: • not to record your disguised PIN on your card • not to disguise your PIN by reversing the number sequence • not to describe your disguised record as a “PIN record” or similar • not to disguise your PIN using alphabetical characters or numbers: A = 1, B = 2, C = 3, etc • not to select or disguise your PIN using any of the following combinations (or parts of them); • dates of birth • personal telephone numbers • car registration numbersfamily members’ names • social security numbers • licence numbers • not to store your PIN in any low security electronic device of any kind, such as (but not limited to): • calculators • personal computers • electronic organisers. There may be other forms of disguise which may also be unsuitable because of the ease of another person discerning your PIN. The Parties shall grant and ensure adequate, effective and non-discriminatory protection of intellectual property rights, and provide for measures for the enforcement of such rights against infringement thereof, counterfeiting and piracy, in accordance with the provisions of this Article, Annex VI and the international agreements referred to therein.

  • Use of Intellectual Property The Adviser grants to the Sub-Adviser a sublicense to use the trademarks, service marks, logos, names, or any other proprietary designations of the Adviser (“AdvisorShares Marks”) on a non-exclusive basis. The Sub-Adviser will acquire no rights in the AdvisorShares Marks, and all goodwill of the AdvisorShares Marks shall inure to and remain with the Adviser. The Sub-Adviser agrees that neither it, nor any of its affiliates, will knowingly in any way refer directly or indirectly to its relationship with the Trust, the Fund(s), the Adviser or any of their respective affiliates or use AdvisorShares Marks in offering, marketing or other promotional materials without the prior express written consent of the Adviser, which approval will not be unreasonably withheld or delayed, except as required by rule, regulation or upon the request of a governmental authority. Notwithstanding the forgoing, the Sub-Adviser and its affiliates may, without obtaining the Adviser’s prior approval, refer directly or indirectly to its relationship with the Trust, the Fund(s), the Adviser or any of their respective affiliates and use AdvisorShares Marks in offering, marketing or other promotional materials provided that such materials were previously approved by the Adviser and remain in substantially the same form.

  • ACKNOWLEDGEMENT AND PROTECTION OF INTELLECTUAL PROPERTY RIGHTS 9.1 The Institution acknowledges that all copyrights, patent rights, trade marks, database rights, trade secrets and other intellectual property rights relating to the Licensed Material are the sole and exclusive property of Publisher or are duly licensed to the Publisher and that this Licence does not assign or transfer to the Institution any right, title or interest therein except for the right to use the Licensed Material in accordance with the terms and conditions of this Licence.
