Securing Vessel. At all times while the Vessel is berthed at the Marina, Owner shall cause it to be safely and properly secured in a manner acceptable to County. If County deems it necessary from time to time to re secure the Vessel for any reason, then on the third and all subsequent occasions necessitating re securing of the Vessel, Owner shall pay County a reasonable service charge for doing so plus the cost of all materials used therefore. However, proper securing of Vessel remains the responsibility of Owner and County does not assume and shall have no responsibility or liability whatsoever for the safety of the Vessel, and shall not be liable for fire, theft, or any damage to the Vessel, its equipment, or any property in or on the Vessel, by reason of County’s decision either to re secure the Vessel or not to re secure the Vessel, except any such damage as is caused by County’s willful injury or sole gross and active negligence in re securing the Vessel.

Securing Vessel. At all times during which the Vessel is berthed at the Slip, Vessel Owner shall cause her to be safely and properly secured in her slip in a manner acceptable to the Marina. This is the Owner's duty alone. All vessels will be secured in the slip with over-sized lines for the size and weight of the vessel. Vessels are to be moored on a minimum of four (4) lines. Spring lines are required. Dock lines will be maintained in a safe manner (non-chafed). The Xxxxxx xxx, at its option, replace or add dock lines and in such event will bill the Owner for this service. Vessels must fit a rubber mooring compensator on each bow and xxxxx line. Any damage to other vessels or docks caused by an improperly secured or unsecured Vessel will be the sole responsibility of the Vessel Owner. If the Xxxxxx xxxxx it necessary to re-secure the Vessel for any reason, Xxxxxx Owner agrees to pay the Marina a reasonable service charge, in the minimum amount of $25.00 per hour, for doing so plus the cost of all materials used. However, the Marina assumes no responsibility for the safety of the Vessel and will not be liable for any damage to the Vessel, her equipment, or any property in or on said Vessel occurring by reason of Xxxxxx's decision either to re-secure the Vessel or to not re-secure said Vessel.

Securing Vessel. At all times during which the Vessel is berthed at the State Facility the Berth Holder shall cause the Vessel to be safely and properly secured in her berth in a manner acceptable to RIDEM. This is the Berth Holder’s duty alone.

In case of an emergency, City is authorized to do whatever City deems appropriate, including boarding the Vessel, moving the Vessel, utilizing auxiliary pumps or taking any other action. If City deems it necessary to re-secure the Vessel for any reason, Vessel Owner agrees to pay City a reasonable service charge for doing so plus the cost of all materials used therefor. However, City assumes no responsibility for the safety of the Vessel and Vessel Owner agrees to release City, and hold City harmless, from any liability for damage to the Vessel, its equipment, and/or any property in or on the Vessel, by reason of City's efforts to re-secure said Vessel or City’s decision not to re- secure Vessel.

In case of an emergency, Xxxxxx is authorized to do whatever it deems appropriate, including boarding the Vessel, moving the Vessel, utilizing auxiliary pumps or taking any other action. If Xxxxxx xxxxx it necessary to re-secure the Vessel for any reason or perform other work, Xxxxxx Owner agrees to pay Xxxxxx a reasonable service charge for doing so plus the cost of all materials used therefor. However, Xxxxxx assumes no responsibility for the safety of the Vessel and shall not be liable for fire, theft or any damage to the Vessel, its equipment, or any other property in or on the Vessel by reason of Marina’s exercise or failure to exercise its right to secure and protect the Vessel.
