SECTION SEVENTEEN. The parties shall update the stipulated agreement concerning the employees in the evening programs at the Technical High Schools and include the updated document in the contract booklet.
SECTION SEVENTEEN. Neither party hereof may assign to third parties its position or rights arising herefrom under any title, nor assign its contractual position, unless it has obtained the express written consent of the other party.
SECTION SEVENTEEN. INSURANCE
SECTION SEVENTEEN. The parties agree that it is their intention and covenant that this agreement and performance under it and all suits relating to it be construed in accordance with and under and pursuant to the laws of the State of Florida, with venue for any lawsuit situate in Broward County. In the event of any dispute between the parties in any way related to this Agreement, the prevailing party shall be awarded its reasonable attorneys' fees and costs through all trial and appellate levels.
SECTION SEVENTEEN. All acts, ordinances, and parts of acts heretofore passed inconsistent with this Agreement are hereby repealed.
SECTION SEVENTEEN. OVERPAYMENT. In the event that the State determines that an employee has been overpaid, the employee will be notified in writing and the State shall meet with the affected employee and the Union. The State will explain how the overpayment or duplicate payment occurred and discuss a repayment schedule. The State shall arrange to recover such overpayment from the employee over the same period of time the overpayment was made unless the State and employee agree to some other arrangement. (For example, an employee who has been overpaid by $5.00 per pay period for six (6) months shall refund the State at the rate of $5.00 per period over six months.) In the event the employee contests whether or how much he/she was actually overpaid or that the above repayment schedule creates an undue hardship on the employee, the State shall not institute the above refund procedure until the appeal is finally resolved through the grievance procedure. The issue(s) may be processed directly to arbitration by the State under the contractual grievance and arbitration procedure.
SECTION SEVENTEEN. Each party executing this Agreement on behalf of a party represents and warrants that such person is duly and validly authorized to do so on behalf of the entity it purports to bind. The parties agree that electronic transmission via facsimile or email to the other party of a copy of this Agreement bearing such parties’ signature shall suffice to bind the party transmitting same to this Agreement in the same manner as if an original signature had been delivered. Without limitation of the foregoing, each party who electronically transmits an executed copy of this Agreement via facsimile or email bearing its signature covenants to deliver the original thereof to the other party as soon as possible thereafter.
SECTION SEVENTEEN. Bilingual Pay A stipend of $1000 annually will be provided to an Employee where it is required for the Employee to be bilingual. Said stipend shall be paid quarterly in the amount of $250.
SECTION SEVENTEEN. REDELIVERY OF PREMISES Tenant shall pay the rent and all other sums required to be paid by Tenant hereunder in the amounts, at the times, and in the manner herein provided, and shall keep and perform all the terms and conditions hereof on its part to be kept and performed, and, at the expiration or sooner termination of this lease, peaceably and quietly quit and surrender to Landlord the Premises in good order and condition subject to the other provisions of this lease. In the event of the non-performance by Tenant of any of the covenants of Tenant undertaken herein, this lease may be terminated as herein provided. SECTION EIGHTEEN
SECTION SEVENTEEN. It is agreed that no waiver or modification of this agreement or of any covenant, condition, or limitation contained in it shall be valid unless it is in writing and duly executed by the party to be charged with it, and that no evidence of any waive or modification shall be offered or received in evidence in any proceeding, arbitration, or litigation between the parties arising out of or affecting this agreement, or the rights or obligations of any party under it, unless such waiver or modification is in writing, duly executed as above. The parties agree that the provisions of this paragraph may not be waived except by a duly executed writing.
