Section 21.2.3. 5 If no settlement has been reached within the five (5) days referred to in the preceding 6 subsection, and the Association believes the grievance to be valid, a written statement of 7 grievance shall be submitted within fifteen (15) working days to the District superintendent or 8 his/her designee. After such submission, the parties will have ten (10) working days from 9 submission of the written statement of grievance to resolve it by indicating on the statement of 10 grievance the disposition. If an agreeable disposition is made, all parties to the grievance shall 11 sign it.
Section 21.2.3. 2 An employee utilizing prescribed and/or “over-the-counter” medication(s) that could adversely 3 affect job safety or performance must immediately report that fact to Food Service Management. 4 Knowledge of cautions and warnings printed on the medication container label are the sole 5 responsibility of the employee. Consultation with the employee’s attending physician, 6 concerning the affects a substance may have on that employee may be appropriate. 8 In the event the employee does notify the Employer immediately upon reporting to work of the 9 fact that such medication is being or will be taken, but does not immediately submit a 10 physician’s release, the Employer may determine that the effects of any over-the-counter or 11 prescribed medication may, under the circumstances, impair the employee’s ability to safely, 12 properly, and effectively perform the employee’s duties and may decline to permit the 13 employee to work until the effects of the medication subside to an acceptable level.
