Section 12.2.1. 34 Should the District decide to discharge any non-annual employee, the employee shall be so 35 notified in writing prior to the expiration of the instructional year.
Section 12.2.1. 44 The parties recognize that an employee should have the option of declining to participate as a 45 member in the Association, yet contribute financially to the activities of the Association in 46 representing such employee as a member of the bargaining unit. Section 12.2.1. 32 Due to the pooling aspect of this insurance agreement, replacement employees and new 33 employees (hired after the start of the year) shall receive insurance benefits as 34 follows: Employees will be eligible for a maximum of the State provided amount per FTE as 35 described in 12.1 and 12.2 above (based on 1,440 hours as 1.0 FTE) per month, effective the 36 1st of the month following the month that the employee completes the minimum amount of 37 days to qualify for benefits. All qualified employees will be included in the first pooling 38 process after date of hire. 39

Each part-time 16 employee’s portion of unused sick leave allowance shall accumulate from year to year to a 17 maximum of 189 days. If an employee resigns and has used sick leave that has not accrued, the 18 employee will have those days (monies) already paid deducted out of their final pay check.
