SCHOOL BUS REQUIREMENTS. The terms and conditions in this Section (i.e., III.2 through III.2.10) shall be considered minimum requirements for a School Bus. Appendix C: School Bus Contract Documents, Number 2: Contract Pricelist, includes supplemental required specifications for each Item. School Buses delivered to an Authorized User in a condition that would be considered unacceptable to a reasonable person may be rejected (see also Appendix B §36 Rejected Product). Criteria which determine this acceptance level shall include, but not be limited to, the general appearance of the interior and exterior of the School Bus for completeness and quality of workmanship, lubrication and fluid levels, with any leaks corrected, mechanical operation of the School Bus and all electrical components operational. Equipment specified to be furnished and installed shall conform to all applicable industry standards.

Contractor shall comply with all applicable standards, orders or regulations issued pursuant to the Federal Water Pollution Control Act, as amended, 33 USC 1251 et seq. Contractor shall report each violation to the recipient and understands and agrees that the recipient shall, in turn, report each violation as required to FTA and the appropriate EPA Regional Office. SCHOOL BUS REQUIREMENTS. The CONTRACTOR shall provide only certified school buses which meet all applicable regulations and laws relating to student transportation in California including all relevant requirements of the California Vehicle Code, Titles 5 and 13 of the California Administrative Code, all applicable rules, regulations and orders of the California Highway Patrol and the California Education Code. All buses must meet or exceed the safety standards for school buses as established by Federal Motor Safety Standards and do not violate the following requirements: All buses shall be Type I buses and shall be no older than seven (7) model years during the term of the contract. All buses shall have tinted windows, AM/FM radios and shall provide forward- facing location for wheelchairs and shoulder straps. All buses provided by CONTRACTOR under this Agreement shall be equipped with air conditioning. Each vehicle must be equipped with a Zonar system or other comparably equipped electronic tracking system. All buses must be equipped with a Child Check System to ensure no child is left on board. CONTRACTOR shall ensure this system is in working order at all times throughout the contract. CONTRACTOR shall provide the SMCOE with any or all reports available from this system as requested by the SMCOE. Each vehicle must be equipped with a video and sound surveillance. SMCOE shall be responsible for providing notification to all students, parents, and SMCOE employees sufficient to constitute consent to the video and sound surveillance under applicable California and federal law. XXXXXXXXXX agrees to post notices on all buses alerting riders to the video and sound surveillance and stating that the cameras may or may not be monitored at any time. All buses the CONTRACTOR proposes to furnish shall be subject to the approval and acceptance of the SMCOE. A bus offered which, in the opinion of the SMCOE, is not suitable for its intended use shall be immediately replaced by a bus of design acceptable to the SMCOE at no additional cost to the SMCOE. All buses shall meet requirements of construction as established by Federal Motor Vehicle Safety Standards Numbers 217, 220, 221 and 222 inclusive. The CONTRACTOR must furnish an Inspection Approval Certificate issued by the California Highway Patrol certifying that any bus used in this Agreement is in compliance with said provisions of the Vehicle Code and Regulations of the State Board of Education.
