Secure Network A computer network that incorporates reasonable security measures to only allow access to Authorized Users by secure authentication, consistent with current industry standards. Text and Data Mining A machine process by which information may be derived from the Licensed Materials by identifying patterns and trends within natural language through methods such as text categorization, statistical pattern recognition, concept or sentiment extraction, and the association of natural language with indexing terms. Usage Data Data collected by the Licensor of the activities or uses on the Platform on the number of chapters, articles or other single items downloaded, printed or viewed from the Licensed Materials.

Secure Network A computer network (whether a standalone network or a virtual network within the Internet) that is only accessible to Authorized Users whose identity is authenticated at the time of log-in and periodically thereafter consistent with current best practice, and whose conduct is subject to regulation by the Member. Text and Data Mining To download, extract and index information from the Licensed Materials. Where required, mount, load and integrate the results on a server used for Licensee and/or the Members’ text-mining system and evaluate and interpret the TDM Output. Licensee and the Members shall use all reasonable efforts to ensure compliance with this License Agreement, including security and technical access requirements. Text and Data Mining Output (“TDM Output”) The result of any Text and Data Mining activity or operation, capable of fixation, reproduction and/or communication in any form, such as in the creation of an index, reference, abstract, relative or absolute description or representation of the Licensed Material, an algorithm, formula, metrics, method, standard or taxonomy describing or based on the Licensed Material, a relational expression or measurement, whether scalable or not, of the Licensed Material, extraction, alternative representation or translation, expression or discussion of any extracts from mined Licensed Material, whether in the form of a direct extraction or a representation in any form which is based on the Licensed Material. Meets Standard: Consistent with the school’s status and responsibilities as a school within a single LEA under the State Department of Education, the school materially complies with applicable laws, rules, regulations and provisions of the charter contract (including the Individuals with Disabilities Education Act, Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act Amendment Act) relating to the treatment of students with identified disabilities and those suspected of having a disability, including but not limited to: • Equitable access and opportunity to enroll • Identification and referral • Appropriate development and implementation of Individualized Education Plans (IEPs) and Section 504 plans • Operational compliance including the academic program, assessments and all other aspects of the school’s program and responsibilities • Discipline, including due process protections, manifestation determinations and behavioral intervention plans • Access to the school’s facility and program to students in a lawful manner and consistent with students’ IEPs or Section 504 plans • Appropriate use of all available, applicable funding Measure 1d Is the school protecting the rights of English Language Learner (ELL) students?
