Common use of SCHEDULE OF WORK Clause in Contracts

SCHEDULE OF WORK. The Construction Manager shall commence work under this Agreement upon receipt of a Notice to Proceed, and shall prosecute the work diligently as described in Exhibit “A” in accordance with the schedule attached as Exhibit “C.” Time is of the essence and failure of Construction Manager to perform work on time as specified in this Agreement is a material breach of this Agreement.

The Construction Manager shall commence work under this Agreement upon receipt of a Notice to Proceed, and shall prosecute the work diligently as described in Exhibit “A” in accordance with the schedule attached as Exhibit “C.C,” and consistent with the general schedule identified Exhibit “E.” Time is of the essence and failure of Construction Manager to perform work on time as specified in this Agreement is a material breach of this Agreement.

Delays beyond the Construction Manager’s reasonable control will not be a material breach.
