Common use of Same Position Clause in Contracts

Same Position. If an employee terminates his or her employment and is rehired 39 by the District into the same position within one year from the date of termination 40 and the position is on the Market Rate Salary Schedule, the employee will be paid 41 his or her base rate (hourly rate) at the time of termination or the Market Rate, 42 whichever is greater.
