Salary Deferral Account. The Plan Administrator shall establish a Salary Deferral Account for each Participant and for those Employees who are not otherwise Participants but for whose benefit Plan-to-Plan Transfers are made which include funds subject to the restrictions on distribution set forth in Code section 401(k)(2)(B).

Salary Deferral Account. Each Participant's Salary Deferral Account to which Employer Salary Deferral Contributions, Matching Contributions and/or Additional Deferral Contributions have been allocated, shall be fully vested at all times and shall not be forfeitable for any reason. Upon termination of employment for any reason, and at any time, a Participant or the Participant's Beneficiary, if applicable, shall be entitled to receive a distribution of these Accounts in accordance with the provisions of Section 7.04.

Such election shall be made by executing before the first day of such Plan Year such election notice as the Administrator may prescribe; provided, however, that upon first becoming eligible to participate in the Plan by reason of appointment to a Board, a Participant may file a Deferral Election not later than 30 days after the effective date of such appointment, which election shall apply to Compensation earned in the portion of the Plan Year commencing the day after such election is filed and ending on the last day of such Plan Year.

  • Account Balance The Servicer must never allow any Custodial T&I Account to become overdrawn as to any individual related Borrower. If there are insufficient funds in the account, the Servicer must advance its own funds to cure the overdraft.
