Royalties for Bulk Compound. In those cases in which Merck sells bulk Compound rather than Product in packaged form to an independent Third Party, the royalty obligations of this Section 5.5 shall be applicable to the bulk Compound (but solely to the extent that a royalty would otherwise be payable on the Product incorporating such Compound).
Royalties for Bulk Compound. In those cases where Merck sells bulk Compound rather than a Licensed Product in packaged form to an independent third party, and is unable to determine Net Sales, the royalty obligations of this Article V shall be applicable to the bulk Compound sold.

In those cases in which Merck sells bulk Program Compound or Small Molecule Collaboration Compound, rather than Product or Small Molecule Product, to Third Parties, and Merck is not being paid on sales of such Products or Small Molecule Products with respect to the applicable bulk Program Compound or Small Molecule Collaboration Compound sold to such Third Party, the royalty obligations of this Section 9.6.1 shall be applicable to Net Sales of such bulk Program Compound or Small Molecule Collaboration Compound, as applicable, and the definition of Net Sales shall apply to such bulk Program Compound and Small Molecule Collaboration Compound mutatis mutandis.

In those cases in which Licensee sells bulk Compound rather than Product in packaged form to an independent Third Party, the royalty obligations of this Section 4.3 shall be applicable to the bulk Compound. In those cases in which Merck sells bulk Selected Collaboration Compound rather than Product in packaged form, or sells Selected Collaboration Compound and Vaccine separately for use in conjunction with one another, to an independent Third Party, the royalty obligations of Section 5.4.1 shall be applicable to (a) the bulk Selected Collaboration Compound together with other components of the Product sold by Merck or its Related Party (i.e. the royalty shall be payable in respect of the entire Product and not just the Selected Collaboration Compound) or (b) the separately sold Selected Collaboration Compound and Vaccine (i.e. the royalty shall be payable in respect of the Selected Collaboration Compound and Vaccine), as the case may be.
Royalties for Bulk Compound. In those cases where MERCK or a Related Party sells bulk Compound rather than Product to a Third Party, the royalty obligations of Section 5.6.1 shall apply to such sale of bulk Compound.
Royalties for Bulk Compound. In those cases where MERCK sells bulk Compound that is directed against the Target for which it was developed under the Research Program, rather than Product in packaged form, to an independent third party, and does not sell the Product in packaged form that is prepared by such third party, the royalty obligations of this Article V shall be applicable to such bulk Compound sold.

In those cases where Interneuron sells bulk Compound to be incorporated into Product, rather than a Product, to a Third Party (excluding sales within or among Interneuron, its Affiliates and/or its sublicensees), and is unable to determine Net Sales, royalties set forth in this Article V shall be calculated as if the bulk Compound is deemed to be Product.
