RISK AND INDEMNITY. The Renter uses the boat park and associated facilities entirely at their risk in every respect and the Marina Society shall have no liability to the Renter or any other person in respect of damage or loss suffered by the Renter arising out of the use of the Boat Park or the associated facilities by the Renter or any other person. The Renter shall indemnify the Marina Society against damage to the Renters property or loss of any kind sustained by the Renter or any other Renter arising out of or caused by the use of the Boat Park or associated facilities by the Renter or the contractors, employers or invitees of the Renter.

The Hirer assumes all risks and liabilities for and in respect of the Equipment and for injuries to or death of persons and damage to property howsoever arising from the possession, use, maintenance, repair or damage of the Equipment by the Hirer unless and to the extent that the same arises as a result of the negligence or default of the Owner. Notwithstanding whether or not the Hirer has effected insurance in respect of the Equipment, the Hirer will indemnify the Owner against loss (including loss under-ground where applicable) or destruction of or damage to the Equipment, whether by fire, theft, accident, seizure, confiscation or any other cause whatsoever, and will indemnify and continue to indemnify the Owner and hold the Owner harmless from and against all losses, damages, claims, penalties, liabilities and expenses (including legal costs on an indemnity basis) howsoever arising incurred as a result of or in connection with the Equipment or the possession, use, maintenance, repair or storage of the Equipment unless and to the extent that the same arises as a result of the negligence or default of the Owner or the seizure or taking of possession of the Equipment by the Owner or by some other party entitled to do so and validity claiming title through the Owner.
RISK AND INDEMNITY. 10.1 As and from delivery of the Equipment to the Nominated Equipment Location, the Customer shall assume all risk and liability for and in respect of the Equipment and for injuries to or death of persons and damage to property howsoever arising from the possession, use, maintenance, repair or storage of the Equipment during the Hire Period except as a result of any defect in the Equipment or any wilful or negligent act of the Owner, its employees, contractors and agents, subject to clause 10.3.

You also agree that, while fulfilling this Agreement, you will comply with all applicable laws or other governmental requirements. You agree that you shall defend, indemnify, and hold harmless HouseLens and its affiliates and their officers, directors, employees, agents, successors and assigns from and against all losses, damages, liabilities, deficiencies, actions, judgments, interest, awards, penalties, fines, or expenses of any kind (including reasonable attorneys fees) arising out of or resulting from: bodily injury, death of any person, or damage to real or tangible, personal property resulting from your acts or omissions, or those of your employees or subcontractors; your breach of any representation, warranty or obligation under this Agreement; and all taxes or contributions, including penalties and interest due to your failure to properly withhold. HouseLens may satisfy an indemnity (in whole or in part) by deducting the amount from any payment due to you.
RISK AND INDEMNITY. 7.1 You shall use the Boat Park/s entirely at your risk in every respect. Council shall have no liability to you or any other persons for any damage or loss whatsoever suffered by you or other persons in respect of the Boat Park/s and its use and whether to themselves, their motor vehicles and their contents, or otherwise.
